ORDINANCE NO. q -2016
BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS,AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE AUTHORIZING THE MAYOR TO
CONTRACT FOR CERTAIN LEVEE REPAIRS, WAIVING
BIDDING REQUIREMENTS, DECLARING AN
EMERGENCY,AND FOR OTHER PURPOSES.
WHEREAS, the city of Van Buren contains within its corporate limits approximately 1.5 miles
of Crawford County's 22 miles of flood control levees, built by the U.S. Army
Corps of Engineers in 1943 to protect the town from the devastation of flood
waters;and
WHEREAS, the annual inspections of the flood control levee system conducted by the City
under the direction of the U.S.Army Corps of Engineers have generally found that
the system remains in good condition; and
WHEREAS, the most recent inspection of the levee revealed pipe erosion in under levee
drainage system(Exhibit"A"); and
WHEREAS, the U.S. Army Corps of Engineers has used Cambridgemoen LLC. of
Gladewater, Texas, for similar repairs to the levee drainage in Corps
maintained levee systems with good results; and
WHEREAS, it would be impracticable to bid the repairs and the city needs to immediately
begin repairs without any delays or any further action by the City Council; and
WHEREAS, section 14-58-303 of the Arkansas Code Annotated provides that"The governing
body,by Ordinance,may waive the requirements of competitive bidding in
exceptional situations where such procedure is deemed not feasible or practical."
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The City Council hereby waives the requirements of competitive bidding for the
above described repairs as such a procedure is not deemed to be practical under
the circumstances.
SECTION 2: The Mayor and City Clerk are hereby authorized to enter into an agreement
(Exhibit"B")with Cambridgemoen LLC. of Gladewater,Texas,for the repairs to
the levee drainage and to make necessary payments from Capital Improvement
funds.
SECTION 3: The repairs hereto are deemed and found to be necessary for the
immediate preservation of health, safety and welfare of the city, and as such an
emergency is hereby declared, and this Ordinance shall take effect and be in full
force upon and after its passage and approval.
IN WITNESS WHEREOF,the City/of Van Buren, Arkansas,by its City Council,
did pass, approve, and adopt, by a vote of le for and c against, the foregoing Ordinance
at its regular meeting held on the 22nd day of February : 6.

Dear Mayor Freeman:
The Corps conducts routine inspections to verify proper operation and maintenance of projects
in its Rehabilitation and Inspection Program(RIP). The results of the recent routine inspection of
the Van Buren Levee and Floodwall by the U.S. Army Corps of Engineers, Little Rock District
are attached as Enclosure 1.
We appreciate the regular maintenance that you perform on the levee. Because of work you
regularly perform and the current condition of the levee, a"Minimally Acceptable" condition
rating has been assigned to the levee. Based on this rating the project will remain active in the
Corps' Rehabilitation and Inspection Program.
The major areas of concern and recommendations for Van Buren Levee and Floodwall are
presented in Table I below. The sponsor should carefully review the inspection report and make
any necessary corrective actions - whether the item of concern was rated acceptable,minimally
acceptable or unacceptable.

Encroachment(Embankment& M A number of encroachments were observed on or near the embankment.
Floodwall) These include billboards,sand stockpiles,and utilities. The encroachments
need to be removed or documentation should be provided to the Corps
showing the unauthorized encroachments do not pose a threat to the
embankment.
Closure Structures(Floodwall) U Three stop log closure structures are located in the segment. The structures
and components appeared to be in good condition,but no trial erection has
been documented with the Corps in the past 6 years. Periodic trial erections
of the stop log closures should be performed.
Culverts/Discharge Pipe M The City provided video of the culvert interior in October 2015. The video
did not show any settling or evidence of significant leaks;however,one of the
culvert ends is corroded through,and the other culvert contains debris that
renders the bottom unobservable. The Corps and the City discussed
maintenance alternatives. The City currently plans to clear one culvert of the
debris and re-video the pipe as well as investigating a lining option for the
culvert with the corroded end section. These corrective measures should be
completed prior to the next inspection currently scheduled for FY 2017.

To complete our records, we request that you provide a schedule of your corrective
maintenance activities and any new levee board members within 30 days after the receipt of this
letter. After you have reviewed the attached inspection report please contact us and we will
gladly discuss any issue and provide technical support within our authority to assist you in
making the required corrections to your levee. I am forwarding a copy of this letter to Ms.
