ORDINANCE NO.10 -2010
BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN
BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED.
AN ORDINANCE TO DEFINE THE DUTIES AND
RESPONSIBILITIES OF THE ELECTED CITY ATTORNEY
FOR THE CITY OF VAN BUREN.
WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the laws of
the State of Arkansas, with all powers, authority and duties of a city of the
first class; and,
WHEREAS, the City of Van Buren desires to restructure the position of City Attorney; and,
WHEREAS, the City of Van Buren needs legal services of many varieties and needs
flexibility in order to ensure that those legal services are provided
efficiently and effectively; and,
WHEREAS, taxpayers will get better service by limiting the role of the elected city
attorney and allowing the city council budget for other legal services.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN, ARKANSAS:
SECTION 1: That the office of the elected City Attorney shall be considered part-time.
SECTION 2: That the duties of the elected City Attorney shall be limited to attending
all Planning Commission meetings, all Regular and Special meetings of the City Council,
ensuring that City Council meetings are conducted lawfully, and to ensure that
ordinances, resolutions, etc., are drafted and read correctly in compliance with local, state
and federal law.
SECTION 3: That the monthly salary for this position shall be $1000.00 /month and
shall include city health insurance as currently provided for elected officials.
SECTION 4; That the City Council authorizes the Mayor as necessary to enter into
contracts for legal services with private attorneys for City business. The City Council
agrees to also authorize the Mayor to enter into an agreement with the Crawford County
Prosecuting Attorneys' office to handle City prosecution.
SECTION 5: That all Ordinances, Resolutions, or parts thereof in conflict herewith are
hereby repealed, that Chapter 2.36 of the Van Buren Code of Ordinances is hereby
amended, and Section 2.36.03 (B) and 2.36.04 of said Code are hereby repealed.
SECTION 6: That this Ordinance shall be effective January 1, 2011.
