SPECIAL CITY COUNCIL MEETING
HELD MAY 8, 2001
A special called meeting of the City Council of the City of Van Buren, Arkansas met at 7:00 p.m., on Tuesday,
May 8, 2001 at City Hall. The meeting was called to order by Mayor John Riggs, presiding officer. Council
members present were Alderman Parker, Moore, Taylor, Pitchford and Barker. Deputy Clerk Connie Hyatt and
City Attorney Candice Settle were also present. Alderman Swaim and City Clerk Barbie Curtis were absent. This
made a total of eight (8)present. A quorum was aeciarea.
The Mayor ordered spread upon the minutes, the"NOTICE OF SPECIAL MEETING, CERTIFICATE OF
SERVICE OF NOTICE AND THE WAIVER OF REGULAR NOTICE OF AND CONSENT TO SPECIAL

On the agenda was to consider an ORDINANCE ALLOWING AN EXCEPTION TO THE
MORATORIUM ON THE PLACEMENT OF SIGNS IN THE CITY OF VAN BUREN. The Deputy Clerk
read the Ordinance the first time in its entirety. Alderman Moore moved that the rules be suspended and the
Ordinance placed on its second reading. The motion was seconded by Alderman Pitchford. On the Clerk's calling
the roll, the following vote resulted: Ayes—Alderman Parker, Moore, Taylor, Pitchford and Barker. The Mayor
declared the motion carried as there were five (5)ayes and 0 nays. Four(4)votes being necessary for passage.
The Ordinance was read the second time.
Alderman Moore then moved that the rules be further suspended and the Ordinance be placed on its third and
final reading. The motion was seconded by Alderman Pitchford. On the Clerk's calling the roll, the following
vote resulted: Ayes—Alderman Parker, Moore, Taylor, Pitchford and Barker. The Mayor declared the motion
carried as there were five (5) ayes and 0 nays. Four(4)votes being necessary for passage. The Clerk then read the
Ordinance the third and final time. The Mayor declared the Ordinance open for discussion.
Alderman Pitchford asked if we could make a list of signs that the Ordinance would allow. City Attorney il
Candice Settle said they could not make a list because it was a general statement and they can't be sure of all the li
signs that might be included. She said there were certain authorities that have the authority to approve or
disapprove which signs would be allowed, other than the City of Van Buren, such as the State Beautification office

in Little Rock, the State Highway Department in Fort Smith and the Historic Commission of Van Buren.
Alderman Pitchford said he regretted voting for the moratorium to start with. Alderman Parker said they did vote
for the moratorium and were already into it for fifty(50) days with only thirteen(13)days left. Nine(9)of those
are working days. Alderman Parker said she thought they should go ahead and cany out the moratorium as voted
on previously. Alderman Moore said he understood what Alderman Parker was saying but he didn't think they k
should punish the ones that had been approved before the moratorium. Alderman Moore moved that the
Ordinance be adopted. The motion was seconded by Alderman Pitchford.
The Mayor then put the question, "Shall the Ordinance pass?" On the Clerk's calling of the roll, the following
vote resulted: Ayes—Alderman Moore, Pitchford and Barker. Nays— Alderman Parker and Taylor. The Mayor
asked the City Attorney if he should vote and she said it was three(3)for and two(2) against. She said it took 2/3
vote to pass the Ordinance and that the Mayor did not need to vote. The Mayor declared the Ordinance passed as
there were three (3)ayes and two(2)nays.
Motion was then made by Alderman Moore and seconded by Alderman Pitchford, that the Emergency Clause
be adopted which motion on roll call the following vote resulted: Ayes —Alderman Parker, Moore, Barker and
Pitachford. Nays—Alderman Taylor. The Emergency Clause carried by the unanimous vote of the Council. The
Mayor then declared the Ordinance duly passed and signed same in open Council, duly attested to by the City
Clerk.

WHEREAS', The City Council issued a Moratorium on the placement of signs in1.
the City of Van Buren for a period of sixty-three(63)days;and
WHEREAS, Certain signs received approval for placement in the City,either
from State or local authorities,prior to the enactment of the Due to error of Press

WHEREAS, The Council feels there should be an exception to the Moratorium Argus Courier the Ord

There being no further business, motion was made by Alderman Moore seconded by Alderman Pitchford to
adjourn. The Council members followed with a unanimous vote. The meeting adjourned at 7:10 p.m.
