SPECIAL CITY COUNCIL MEETING
HELD JANUARY 10, 2001
A special called meeting of the City Council of the City of Van Buren, Arkansas met at 6:30 p.m., on
Wednesday, January 10, 2001 at City Hall. The meeting was called to order by Mayor John Riggs, presiding
officer. Council members present were Alderman Swaim, Parker, Moore, Taylor, Pitchford and Barker. City
Clerk Barbie Curtis and City Attorney Candice Settle were also present. This made a total of nine (9) present. A
quorum was declared.
The Mayor ordered spread upon the minutes, the "NOTICE OF SPECIAL MEETING, CERTIFICATE OF
SERVICE OF NOTICE AND THE WAIVER OF REGULAR NOTICE OF AND CONSENT TO SPECIAL
MEETING."

NOTICE OF SPECIAL MEETING TO THE CITY COUNCILMEN
OF THE CITY OF VAN BUREN, ARKANSAS
Notice is hereby given that a Special Meeting of the City Council of the City
of Van Buren, Arkansas, will be held at the Municipal Complex at 7:00 P.M. on
Wednesday, January 10, 2001, for the following purpose:
1. Consider Ordinance Authorizing the Mayor to
Contract Services for the Removal of Debris
Resulting from the recent ice storm.
2. Discussion of Ice Storm and problems related
to the clean up.

I, Barbie Curtis, the duly appointed, qualified and acting City Clerk-Treasurer,
of the City of Van Buren, DO HEREBY CERTIFY that on the 10th day of January,
2001, I served a true copy of the foregoing Notice of Special Meeting to each
and every Councilman of the City of Van Buren, Arkansas, by handing a copy to
each, in the manner provided in the By-Laws.

WAIVER OF REGULAR NOTICE OF AND CONSENT TO SPECIAL MEETING
We, the undersigned City Councilmen of the City of Van Buren, Arkansas, do hereby
accept service of the NOTICE OF SPECIAL MEETING waiving any and all
irregularities in such Service and in such Notice and Consent agree that the said
City Councilmen of the City of Van Buren, Arkansas, shall meet at the time and
place named in such Notice and for purpose stated therein.

On the agenda was to consider an ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO
CONTRACTS FOR EMERGENCY SERVICES. The Clerk read the Ordinance for the first time in its entirety.
Alderman Swaim moved that the rules be suspended and the Ordinance placed on its second reading. The motion
was seconded by Alderman Taylor. On the Clerk's calling the roll, the following vote resulted: Ayes—Alderman
Swaim, Parker, Moore, Taylor, Pitchford and Barker. The Mayor declared the motion carried as there were six(6)
ayes and(0)nays. Four(4)votes being necessary for passage. The Ordinance was read the second time.
Alderman Parker then moved that the rules be further suspended and the Ordinance be placed on its third and
final reading. The motion was seconded by Alderman Swaim. On the Clerk's calling the roll, the following vote
resulted: Ayes—Alderman Swaim, Parker, Moore, Taylor, Pitchford and Barker. The Mayor declared the motion
carried as there were six(6)ayes and(0)nays. Four(4)votes being necessary for passage. The clerk then read the
Ordinance the third and final time. The Mayor declared the Ordinance open for discussion. Alderman Swaim said
this would cost high dollars but they have no choice. Alderman Barker asked what type of equipment would be
used. Mayor Riggs said it would depend on who contracts the clean up. Alderman Swaim said they would
probably use front-end loaders. Alderman Taylor asked how quick they were going to start this. The Mayor said
hopefully next week. Alderman Barker asked how they are going to bid this job out. Mayor Riggs said FEMA
would give us some ideas and then we will use whichever ones we need for our City. Don Mullens and Jack
Bernard were both present, they explained that FEMA would pay 75%, 121/4%would be paid by the State and 12
1/4%would be the cities responsibility, which could be done by in kind match. The Mayor said Mr. R.G. Copeland
is our FEMA representative.
The Mayor then put the question, "Shall the Ordinance Pass?"Motion was made by Alderman Swaim and
seconded by Alderman Parker to adopt the Ordinance. On the Clerk's calling the roll, the following vote resulted:
Ayes—Alderman Swaim, Parker, Moore, Taylor, Pitchford and Barker. The Mayor declared the Ordinance passed
as there were six(6) ayes and(0)nays. Four(4)votes being necessary for passage.
Motion was then made by Alderman Taylor and seconded by Alderman Swaim, that the Emergency Clause be
adopted which motion on roll call carried by the unanimous vote of the Council. The Mayor thereupon declared
the Ordinance adopted and signed the Ordinance, which was attested by City Clerk and impressed with the seal of
the City.

Alderman Taylor seconded by Mayor Riggs made a motion to adjourn. The Council members followed with a
unanimous vote. The meeting adjourned at 6:50 p.m.
