CITY COUNCIL MEETING JULY 21,2014
The City Council of the City of Van Buren,Arkansas met at 7:00 p.m. Monday, July 21,
2014 at City Hall. The meeting was called to order by Mayor Freeman. On roll call,the
following Council members answered as their names were called: Alderman Parker, Blake,
Moore, Ragsdale Dodd, and Sagely. City Clerk-Treasurer Barbie Curtis and City Attorney
Candice Settle were present. This made a total of nine (9)present. A quorum was declared.
The invocation was given by Col. Pete Gauger, 188th Vice Wing Commander.
Next, Mayor Freeman led the Pledge of Allegiance.
Next, members of the 188th Fighter Wing made a presentation to the council.
On the agenda next, Mayor Freeman asked to adopt the minutes of the Council Meeting
on June 16, 2014. Alderman Parker made a motion to approve the minutes. Alderman Dodd
seconded the motion. On roll call,the following Council members voted aye: Alderman Dodd,
Sagely, Parker, Blake, Moore and Ragsdale. The following voted nay: none.
Next, Mayor Freeman asked to adopt the minutes of the Special Council Meeting on July
8, 2014. Alderman Dodd made a motion to approve the minutes. Alderman Sagely seconded the
motion. On roll call,the following Council members voted aye: Alderman Dodd, Sagely,
Parker, Blake, Moore and Ragsdale. The following voted nay: none.

On the agenda next was to consider A RESOLUTION TO AUTHORIZE THE
MAYOR AND CITY CLERK TO REMOVE AND DISPOSE OF CERTAIN FIXED
ASSETS FROM THE CITY OF VAN BUREN'S FIXED ASSET INVENTORY, BY
SEALED BID,AUCTION OR OTHER METHODS AUTHORIZED UNDER THE LAW,
AND FOR OTHER PURPOSES. The Clerk read the Resolution in its entirety. Mayor
Freeman asked if there was any discussion. Mayor Freeman provided an explanation that the
equipment is broken and cannot be fixed. Alderman Parker seconded by Alderman Ragsdale
moved that the Resolution be adopted. On the Clerk's calling the roll, the following vote
resulted: Ayes—Alderman Dodd, Sagely, Parker, Blake, Moore and Ragsdale.Nays—none.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which
was attested by the City Clerk and impressed with the seal of the City.

RESOLUTION TO BE ENTITLED:
A RESOLUTION TO AUTHORIZE 1'HE, MAYOR AND CITY CLERK TO
REMOVE AND DISPOSE OF CERTAIN FIXED ASSETS FROM THE CITY OF
VAN BUREN'S FIXED ASSET INVENTORY,BY SEALED BID,AUCTION OR
OTHER METHODS AUTHORIZED UNDER THE LAW,AND FOR OTHER
PURPOSES.
WHEREAS, the City of Van Buren has certain fixed assets on its Fixed Asset Inventory List which are obsolete,
and/or beyond repair,and are no longer cost effective,so as to no longer be needed by the City;and
WHEREAS, after an inventory of fixed assets,it is therefore recommended by our State Auditor that said items or
item be removed from the City's Fixed Asset Inventory and disposed of by sealed bid,auction or as
otherwise authorized under Arkansas law.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN,ARKANSAS,
THAT:
SECTION 1: The Mayor and City Clerk are hereby authorized to remove the following asset or assets from the
Fixed Asset Inventory and to dispose of same by sealed bid,auction or other such methods authorized
under the law:

On the agenda next was to consider AN ORDINANCE FOR COMPLIANCE WITH
ARK. CODE ANN. § 14-42-107, TO CONDUCT BUSINESS WITH AN OFFICIAL OR
EMPLOYEE OF THE CITY OF VAN BUREN, FOR EXTERIOR PAINTING SERVICES
FOR THE CITY OF VAN BUREN; AND FOR OTHER PURPOSES. The City Clerk read
the Ordinance in its entirety. Alderman Ragsdale moved that the rules be suspended and the
Ordinance be placed on its second reading. The motion was seconded by Alderman Parker.
The council followed with a unanimous vote. The City Clerk then read the Ordinance the second
time.
Alderman Dodd moved that the rules be further suspended and the Ordinance placed on
the third and final reading. The motion was seconded by Alderman Parker. The council
followed with a unanimous vote. The City Clerk then read the Ordinance the third and final
time. The Mayor asked if there was any discussion. There was none.
The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by
Alderman Parker and seconded by Alderman Ragsdale to adopt the Ordinance. On the Clerk's
calling the roll,the following vote resulted: Ayes—Alderman Dodd, Sagely, Parker, Blake,
Moore and Ragsdale.Nays—none. The Mayor declared the motion carried as there were six (6)
ayes and (0)nays. Four(4)votes being necessary for passage.

ARKANSAS,AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE FOR COMPLIANCE WITH ARK. CODE

conducting of any business between an official or employee of the city and the City of
Van Buren;and
WHEREAS, the City of Van Buren and the Van Buren Police Department wishes to conduct business,
with Brad Lipe Painting,a business owned and operated by city employee Brad Lipe;and
WHEREAS, it is the desire of the Administration and the Van Buren City Council to comply with
A.C.A.§14-42-107 for the conducting of all city business.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
1'kIE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: Brad Lipe Painting,which is owned by city employee Brad Lipe of Van Buren,is hereby

BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS;AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE AUTHORIZING AN OWNER OFA GOLF CART TO OPERATE THE
GOLF CART UPON CITY STREETS FROM HIS OR HER.RESIDENCE TO AND
FROM A''GOLF COURSE;REPEALING ANY ORDINANCES IN CONFLICT;PROVID-
ING PENALTIES FOR VIOLATION THEREOF;AND FOR OTHER PURPOSES.
WHEREAS Arkansas Code Annotated §14-54-1410 provides that it shall be
within the'municipal affairs and authority of any municipality in the State of
Arkansas.to allow any owner of a golf cart to operate'under certain circum-
stances,a golf cart upon the city streets of the municipality.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,ARKANSAS,THAT:,
SECTION 1:Pursuant to A.C.A.§14-54-1410,golf carts may be operated by the
owner upon the city streets without such cart's being registered or licensed
under the applicable section of motor vehicle registration and licensing stat-
utes and ordinances of the city for thepurposeof traveling to and from the
owners residence and a golf course as set forth herein.
SECTION 2:It shall be unlawful to:
a.Operate a golf cart on any city street which is also designated as federal or
state highway or as'a county road as set forth in A.C.A.§14-54-1410;
b.To operate a golf cart on any city street for purposes other than driving di-
redly to or from the golf course and the owners residence;,
c.To operate a golf cart while under the age of sixteen years;
d.To operate a golf cart without having a valid operator's license in the owne-
rs possession at the time of operation of the golf cart;.
e.To operate a golf cart other than during daylight hours;
f.To operate a golf cart in violation of any other federal,state or local ordi-
nance,statute,or law dealing with motorized vehicles except as permitted by
this section
SECTION 3:Any person violating any of the provisions of this Ordinance shall,
upon conviction,be punished by a fine not to exceed$500.00 per occurrence.
SECTION 4:The_various provisions and,parts of this Ordinance are hereby de-
clared to be severable and,if any section or part of a section,or any provision
or part of a provision herein,is declared to be unconstitutional,inappropriate,
or invalid by any court of competent jurisdiction,such holding shall not invalid-
ate or affect the remainder of this Ordinance and to that extent the provisions.

Next on the agenda was the Financial Statement. Motion was made by Alderman Dodd
and seconded by Alderman Ragsdale to appropriate the sum of$ 1,328,531.16 to pay expenses
and salaries for June 2014,presented by the City Clerk. The Council followed with a unanimous

Next Police, Fire, Building Inspector, Engineer and Ambulance Reports were presented
for filing. There being no further questions or changes,the reports were filed as submitted.
Next on the agenda was Miscellaneous and General Discussion. The council had a
request from Lawbreakers and Peacemakers to close 7th Street for performances on August 2nd
and August 23rd 2014. Alderman Parker commented that she did contact Cathy Gifford because
her business address would be effected by the street closing. Ms. Gifford stated she had no
renters scheduled for those days. Motion was made by Alderman Parker and seconded by
Alderman Ragsdale to approve the request. The council followed with a unanimous vote.
Mayor Freeman stated that the new complex security started today, and reminded the
council that the ribbon cutting for the new fire station will be Friday morning at 10:00.
Mayor Freeman then recognized John Pope for his award he received in Little Rock and
thanked him for all he does not only for the City of Van Buren but also for the State of Arkansas.
Jennifer McKinney asked if there will be a tour of the new fire station at the ribbon
cutting. Mayor Freeman replied yes.
There being no further business, motion was made by Alderman Parker and seconded by
Alderman Dodd to adjourn. The Council followed with a unanimous vote. The meeting
adjourned at 7:30 p.m.
