ORD NO 22-2005 CITY OF VAN BUREN, ARKANSAS
ORDINANCE NO. as -2005
AN ORDINANCE AMENDING ORDINANCE NO. 26 -1978, PROVIDING
INSURANCE BENEFITS FOR ELECTED OFFICIALS.
WHEREAS, Ordinance No. 26 -1978 provides continued medical benefits for elected
officials who have ten or more years of service to the City upon
retirement; and
WHEREAS, Due to the increased financial burden to the City of complying with the
Ordinance in the future, the Council desires to amend said Ordinance in
such a manner that the City is not subjected to possible litigation but
which limits the City's future financial burden in providing benefits to
retired officials.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS:
SECTION 1: THAT Ordinance No. 26 -1978 is hereby amended to the extent that any
elected official having provided service to the City at the time of the
passage of this Ordinance is eligible to receive benefits as set out by
Ordinance No. 26 -1978 upon meeting the ten year service requirement.
Any new official who is elected to serve who has no previous service to
the City is not eligible for benefits under Ordinance No. 26 -1978.
SECTION 2: Any new official who is elected to serve who has no previous service to
the City as of the passage date of this Ordinance is entitled to benefits
under state law. Specifically, an elected official of any age who has ten
years of service to the City will be able to continue their health
insurance upon leaving City service, but will be required to pay for said
benefits. It is the Council's specific intent to expand upon the benefits
provided by A.C.A. Section 24 -12 -129 to elected officials.
SECTION 3: The provisions and sections of this ordinance shall be deemed to be
severable, and the invalidity of any portion of this ordinance shall not
affect the validity of the remainder.
