ORD NO 13-1960A ORDINANCE NO. 13 -1960 CITY OF VAN BUREN, ARKANSAS AN ORDINANCE PROHIBITING LOITERING AND SLEEPING IN CERTAIN PLACES BETWEEN THE HOURS OF 10:00 P.M. AND THE DAY -LIGHT HOUR THEREAFTER, AND PROVIDING FOR FINES FOR VIOLATION THEREOF. WHEREAS, the City of Van Buren, Arkansas has been faced with the problem of a number of break ins; and WHEREAS: the police have noticed a great number of young men over the age of 18 parking and loitering around without any apparent reason therefore, and WHEREAS, our curfew law does not apply to this age group and WHEREAS, this ordinance is necessary for the prevention of crime. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS. SECTION 1. LOITERING AND SLEEPING IN CERTAIN PLACES. It shall be unlawful and an offense, between the hours of 10:00 o'clock P.M. and the daylight hour thereafter, for any person to loiter or wander aimlessly upon or about the streets, alleys, or other public highways, or parks of said city, or upon private lots, around vacant or occupied build- ings or railway property, or yards, who has not a lawful reason for being at such place, at such time, or to sleep in or about any such place or within any place, or upon any bench or chair provided for public accommodation, without lawful authority or permission so to do. SECTION 2. FINES FOR VIOLATION THEREOF. Any person violating the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not less than 525.00 nor more than 5250.00 or imprisonment in the City Jail not to exceed 30 days, or by both said find and imprisonment. SECTION 3. EMERGENCY. It being immediately necessary for the preservation of the peace, health, and safety of Van Buren, Arkansas and the inhabitants thereof, that the pro- visions of this Ordinance shall take effect and be in full force from and after its passage, approval and publication.
