ORD NO 11-1960 ORDINANCE NO. '11 -1960 ORDINANCE WHEREAS, a petition was duly filed with the City Council of the City of Van Buren, Arkansas, on the 3rd day of October, 1960, praying and requesting the City Council of Van Buren, Arkansas, to vacate and abandon all that portion of Second Street running East from Cane Hill Street to the property line of the St. Louis -San Francisco Railroad Company in Von Buren, Arkansas. WHEREAS, after due notice at required by low, having been published as required by law, the City Council of Van Buren, Arkansas, has at the time and place set forth in the notice, heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described hos not been open and no crossing has been maintained at the St. Louis -San Francisco Railroad Company on said Second Street for more than five (5) years, and the same has not been used generally by the public; that all the owners of the property abutting upon the portion of the street to be vacated have filed with the City Council of Van Buren, Arkansas, their written consent to such abandonment and that the public interest and .jelfare will not be adv.er,sely affected by the abandonment of such street. -NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Van Buren, Arkansas; Section 1. The City of Van Buren, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, SUBJECT HOWEVER, to any and all rights of any public utility, with reasonable rights of ingress and egress for the purpose of repairing, replacing, maintaining, removing or improving any existing public utility, whether the same be publicly or privately owned, in and to the street designated as follows: That protion of Second Street extending East from Cane Hill to the St. Louis -San Francisco failroad Company, and filed for record in the Plat Book at Page in the County records in the officd of the Circuit Clerk and Recorder for Crawford County, Arkansas. Section 2. A copy of the Ordinance duly certified by the City Clerk shall be filed in the Office of the recorder of Crawford County, Arkansas, and recorded in the deed records of the County.
