ORD NO 08-1960 THE CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 8 -1960, AN ORDINANCE ENTITLED: AN ORDINANCE TO PROVIDE FOR THE REFUSAL AND OR DISCONTINUANCE OF CITY WATER SERVICE TO ALL PREMISES PAILING TO"MEET THE PLUMBING REQUIREMENTS OF THE ARKANSAS STATE PLUMBING CODE OF THE CITY OF VAN BUREN, ARKANSAS, ®ND OF THE ARKANSAS STATE BOARD OF HEALTH, AND AUTHORIZING AND DIRECTING THE CITY PLUMBING INSPECTOR AND THE CITY WATER DEPARTMENT TO DISCONTINUE WATER SERVICE TO PREMISES FAILING TO MEET SAID REQUIREMENTS, AND TO REFUSE SERVICE TO NEW CUSTOMERS FAILING TO MEET SAID REQUIREMENTS, AND DECLARING AN EMERGENCY, AND FOR OTHER RELATED PURPOSES. WHEREAS, the City of Van Buren, Arkansas, owns and operated, in a governmental capacity, a water system as a municipal utility; and WHEREAS, the City of Van Buren, Arkansas is desirous of maintaining a pure ::r potable water system, and prohibiting all back flow, or back syphonage into said water system: and, WHEREAS, there now exists in, on or about premises in the City of Van Buren, Arkansas, plumbing which does not meet the requirements of the Arkansas State Plumbing Cude and the regulations of the Arkansas State Board of Health regulating the installation of water lines and plumbing fixtures in and on said premises to assure a pure or potable water system; BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT, '1 gi /3 Yaw E To 0.�. /4.4 4 ^t. The Van Buren Water Department, and the City Plumbing Inspector of the City of Van Buren, Arkansas, be and they are hereby authorized to discontinue or cease to be discone tinued all water service cr services to any and all premises, lands, buildings or structures where it iS found that an immediate hazard exists to the purity or potability of the City Water supply, by reason of the requirements of the Arkansas State Plumbing Code and the City uf Van Buren, Arkansas Plumbing Code and the regulations of the Arkansas State Board of Health having been complied with, or to refuse service to new customers who have not so c vl ied. SECTION 2. The City Water Department of the City of Van Buren, Arkansas and the City Plumbing Inspector of the City of Von Buren, Arkansas, be and they are hereby authorized and directed to take such steps as necessary to determine all potential hazards to the purity or potability of the City Water supply which exist. Upun determining said potential hazards, it shall be the duty of said deportment uf said department and said inspector to immediately cause notice to go to the owner of such other person responsible fur said premises, specifying said hazards, and notifying said person that in the event that said hazard is not corrected within two weeks fr:rn the date uf said notice, all water services shall be discontinued thereafter until the requirements of the Arkansas State Plumbing Code, the City of Van Buren, Arkansas Plumbing Code, and the regulations of the State Board of Health have been complied with. The said City Water Department is authorized and directed to refuse service to any new customers unless and until the City Plumbing Inspector of 11/ the City of Vnn Buren, Arkansas has notified the City Water Department that the customer hes complied with the requirements of the Arkansas State Plumbing Ccdu, The City of Van Buren Plumbing Code and the regulations of the Arkansas State Board of Health hove been complied with. SECTION 3, EMERGENCY CLAUSE. The City Council of the City of Van Buren, Arkansas, hereby finds and declares that the public health, safety and welfare has been or will be injured through improper plumbing and improper plumbing fixtures which permit or may permit contamination of th&j City water supply and that this Ordinance is necessary for the public health and safety, and an emergency is hereby declared to exist, and this Ordinance shall be in force and effect from and after its passege and approval, and publication.
