ORD NO 02-1960 ORDINANCE NO. 2 -1960 CITY OF VAN BUREN, ARKANSAS AN ORDINANCE ENTITLED: AN ORDINANCE GRANTING AN EXCLUSIVE BUS FRANCHISE TO THE TUIN CITY LINES INC. FIXING SEVICES, FAITS, PE;MIT FEES, DESIGNATING THE BUS ROUTE, DEFINING BOULEVARDS AFFECTED, AND FIXING RESPONSIBILITY OF GRANTEE, AND FUR OTHER PUR -O5E5. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS. SECTION 1. The Twin City Lines, Inc. e corporation demicilied in Fort Smith, Arkansas, and its successors and assigns, shall have end it is hereby granted an exclusive franchise and right of way for a periud of fifteen (15) years from and after the passage of this ordinance to maintainend operate a passenger and package motor bus line over and ,long the following streets in the City of Van Buren, Arkansas, to wit: Beginning on first street at the North end of the Fort Smith Van Buren free bridge; thence northeast across the wiaduct over the Missouri Pacific tradks to South Fourth Street, thence Southeast along South Fourth Street to Broadway; thence Southwest along Broadway to third Street, thence Northwest along south third street to Main Street, thence Northeast along main Street to East Main Street; thence East along east main street tp North 20th Street; thence North along North 20th Street to Alma Boulevard; thence west along Alma Boulevard to North 16th Street ;•thence South along North 16th Street to Poplar; thense West along poplar to North 15th Street; thense South along North 15th Street to East Main Street; thense west along East Main Street to Main Street; thense South west on Main Street to Fourth Street; thense Southeast along south Fourth Street to the viaduct; thense Southwest across said viaduct to the point of beginning, and this route to be followed in the operation of said bus system until by further agreement same may be altered or changed; SECTION 2. Said Twin City Lines, Inc., its successors and assigns shall during the life of this franchise, maintain and keep in eperati.n a sufficient number of standard, city motor busses of sufficient, passenger ccpacity to furnish adequate transportation facilities to serve the ccnvinience of the public, over and along such route and shall operate same on a regular schedule time,, except in cases of emergency, or unavoidable delay, and shall keep said busses in good order and repair and shell fumigate some daily fur the prevention _f disease. SECTION 3. Said Twin City Lines, Inc. its successors and assigns shall hove the right to charge and collect, within the City of Van Buren, a fair of Fifteen (15) Cents per passinger er, two tokens for twenty Five (25) Cents. Transfers to other busses Two (2) Cents. SECTION 4. Said Twin City Lines, Inc., its successors and assings, shall pay to the City of Van Buren, for the use of its streets, nut to exceed the sum of 225.00 per yuor per bus, for the number of busses operated cn said bus route and in no case shall the total amount paid be less than ii100.09 per year. SECTION 5. All of said streets herein designated ns the route ever which said motor bus system is »ermitted to be operated, where some have not olrendy been made boulivars by Ciiy Ordinances shall be and they are hereby declared to be boulevards over which all traffic shall have right uf way over the traffic on all streets intersecting therewith except where such route may enter or intersect a through State Highway. SECTIL.N 6. S::.id Twin City Lines, Inc. its successors and assigns, shall hove permission, during the life of this franchise to transport passengers within the City of Van Buren, over the route designated or such other route or routes as may hereafter be designated by amendment hereto, and to pick up and deliver within the City uf Van Buren, along said route passengers to and from the City of Fort Smith, to carry mail, packages and express, if otherwise authorized, and to tr•nsect ;end carry on any other business which is usual and customary for City and Inter City Motor bus transportation system. SECTION 7. 5-id Twin City Lines, Inc. its sucessors and assi§ns, shell, in nll cases, save and keep harmless the City of Van Buren from any and all damages resulting to any person by neglect and carelessness of any employee having control ever or operating any such motor bus, or any other person employed in the management thereof in any capacity, and Savo and keep harmless the City of Van Buren from all injuries or dmmoges that may be suffered by any person, or that may bp caused to be done to the property of any person by reason of the wrengfull operation of said motor bus system. SECTION B. This ordinance must be accepted in writing by the said Twin City Lines, Inc., it successors and assigns, before same shall become effective and such ncceptn.nce and operation of All said motor bus line shall toguthur with this ordinance and any amendment thereto, which may bo later enacted constitute the contract and agreement between the City of Von Buren, and said Twin City Lines, Inc. its successors and assigns. SECTION 9. That this franchise is a renewal uf a franchise now held by the Twin City Linos, Inc, granted by the Council on the 5th day of February, 1945 to the Twin City Coach Company with all amendments, and ether ordinances and parts uf ordinances in conflict herewith are hereby repealed provided this repealing clause shall not take effect until the final ,acceptance of this franchise by the said Twin City Lines, Inc. SECTION 10. That due to the expiration of the franchise this ordinance being necessary for the public health, peace, safety S and convenience of the public an emergency is hereby declared and this ordinance shall be in full force and affect from the date of the passage, publication and final acceptance in writing by the Twin City Lines, Inc. of Fort Smith, Arkansas.
