ORDINANCE OF THE CITY OF VAN BUREN, ARKANSAS, GRANTING TO
PAUL COMSTOCK, DOING BUSINESS AT T. V. CABLE RECEPTION COMPANY,
AND ITS SUCCESSORS AND ASSIGNS, A PERMIT 1f0 LOCATE, CONSTRUCT;
MAINTAIN AND OPERATE A TELEVISION ANTENNA SERVICE AND DISTRIBUTION
SYSTEM BY MEANS OF COAXIAL CABLE AND FOP MICRO'! =LAVE TRANSMISSION
AND DISTRIBUTION SYSTEM IN THE CITY OF VAN .'UREN, ARKANSAS:
AUTHORIZING THE USE, EIGHT PRIVILEGE, H-,WER AND AUTHORITY TO
CONSTRUCT, MAINTAIN, OPERATE AND REMOVE IN, OVEIi AND ACROSS THE
STREETS, AVENUES, ALLEYWAYS AND PUBLIC PLACES THE NECESSARY
EQUIPMENT FU„ THE OPERATION OF SAID SYSTEM IN THE CITY OF VAN
BUREN, ARKANSAS, PROVIDING FOR THE REGULATION THEREOF AND PERMIT
FEES FOR SAID OPERATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY CF VAN
BUREN, ARKANSAS:
SECTION: 1. There is hereby granted :.;y the City of Von
Buren, Arkansas (hereinafter called City) tc Paul Comstock,
doing business as T. V. Cable Reception Company, (hereinafter.
called Grantee) and its successors and ,assigns, thu rights and
privileges for a period of 2 years from the effective dote of the
Ordinance to locate, construct, maintain in the present end future
street, alloys and public plows of the City of Van Buren,
necessary, needful, and /or convenient wiring, cables, poles,
pole eires, underground conducts, manholes, transformers,
appliances and other apparatus fur the purposo of operating and
extending to thu Citizens of Van Buren, and the inhabitants
thereof, a television antenna and distribution system. There is
hereby granted the father right, privilege and authority to the
Grantee to lease, rant, er in any other manner obtain the use of
such towers, poles, lines, cables and other equipment and
facilities from any and all holders of public licenses and
franchises.within the corporate limits cf the City of Van
Buren, Arkansas, and to use such towers, poles, lines, cables
and ether such equipment and facilities, subject tc all the
existing and future Ordinances and regulations of the City.
SECTI!.N 2. The Grantee shall at all times make and keep
full and complete plats, maps and records showing the exact
location of all connections to homes, buildings and other
structures served by Grantee in Van Buren,
11 SECTION 3. The Grantee shall comply with all Ordinances and
regulations with respect to construction, repairs, extension and
maintenance of its facilities and shall indentify and hold
harmless the City from any and all liabilitios, claims, demands
or judgments growing out .:f injury to any .:orsen or damage to
any property as the result of the violation er failure on the
part cf the Grantee to observe its proper duty arising out of
the construction, repair, extension, maintenance, er operation
of its facilities used in ccnnectiLn with the permit.

SECTION 4. All installation of cquipm::nt shall be of a
permanent nature durable and installed in accordance with good
engineering practice, and of sufficient height or depth to
comply with all existing City regulations, Ordin noes, and State'
laws so as not to interfere in any manner with the rights of the
public or individual property owner and shall not interfere with
the travel and use of public places by tho public, and during the
construction, repair er removal thereof, shall not obstruct or'
impede traffic.
SECTION 5. The City res_rvus the right of reasonable
regulation of the crecti n 2nd construction af any work by the
Grantee and ro roasunablo designate where such work and cnnstruc—
tiin are to be placed. The Grantee shall, when requested by the
City, make minor changes in its equipment to conform to the
reasonable necussnry requirements of smell localized areas,
such changes to ho affected within o rJas-noblo time after
request is made.
SECTION 6. Thu Grantee shall have the right to assign this
permit, subject to the approval of the City Council of thu
City of Von Buren, Arkansas.
SECTION 7. The Grantee shall make vailable substantial
survico under this permit within two (2) years from the date of
thu granting of the permit.
SECTION B. The Grantee shall pay the City the sum of
;100.00 par annum so long as Grantee continues to operate and do
business under thu permit herein granted; provided that after the
Grantee has been doing business for a period two (2) years the
fee to be paid may be renegotiated by Dither party given thirty
(30) days written noticu.
SECTION 9. That be reason of the immediate necessity of
providing tho public with a sound pay T. V. System, an emergency
is hereby declared to exist, and this Ordinance being necossnry
for the immediate preservation of the public peace, health, and
safety shell take effect and be in force frum and after its
passage, approval and publication.
