ORD NO 08-1962 ORDINANCE NO. 0 -1962 AN ORDINANCE LEASING CERTAIN LAND IN THE CITY PARK TO THE VAN BUREN RIDING CLUB, INCORPORATED, FOP DEVELOPMENT. `:JHEREAS: The VT.n Buren Pork and Recreation Commission has consulted with the Von Duren Riding Club, Inc., in regard to dcgeloping n rode_: aronn and other recreational f•::cilitios; and ';'HERERS: The Van Buren Pnrk and Recreation Commission has ei t roc_:mmended tho leasing of the land to the Van Buren Riding Club, Inc., for development; BE IT ORDAIN•JE_, BY THE CITY COUNCIL OF THE CITY JF VAN BUREN, ARKANSAS: SECTION 1. The Movor and the City Clerk are hereby authorized and directed to execute in the name of the city f Van Buren, Arkansas, a lease for 25 yenrs with an option fur an additional 25 years- tel.the Van Buren Riding Club, Inc., to the following described roal'estate: Beginning at northwest corner of Lot 1, Perkviuw Add'n to City of Von Buren, Ark.nnsos, thence cast 1500 feat along back line of Porkview lets; thence north to inter- sect Park Road; thence northerly following said Perk Road to the main drainage oroo.; thence southwesterly along drainage area to n;:.rth Thirteenth Strout; thence south to point of bdginning approximately 302.2 feet. SECTION 2. If the Van Buren Park and Recreation Commission need the portion east of the ridge the Von Duren Riding Club, Inc., will release this portion of the lensed premises upon request of tho Van Buren Park and Recreation Commission. SECTION 3. The purpose of this loose is for to construction cnd operation of certain rodeo and rocreotionol fccilities to.be under the control of the executive board of the Van Buren Riding Club, Inc. Thu facilities to -be built shall be of c permanent nature and will fit the pattern of the development of tho Pork as promulgated by the Von Burdn Park and Recreation Commission, and upon the termination of this lease shall become the property of the City. Thu facilities will be constructed and operated in such c manner as not to bu a nuisance either to the rest cf tha Park or tho residents of the locality. SECTION 4. The Van Buren Riding Club, Inc., will comply with Section 12 of the Stoto Board of Health Rules and Regulations pertain- ing to Genircl 5nnitoticn which states: "No person, firm, corporation ur governmentol agency may keep or shelter feels or cnimcls in such n rnnnner that results in n public health nuisance." The Von Buren Riding Club, Inc., will take adequate measures to guard eg,i nst dust and fly problems; and snim.als kept overnight sh_,1l be stabled in o location to be -greed upon between the Von Buren Riding Club, Inc., and the Van Buren Perk and Recreation Commission. SECTION 5. The Van Buren Riding Club, Inc., will charge a reasonable admission or price to the general public for the use of the facilities or services. Such ch.rges will be subject to the approval of the Von Duren Park and Recreation Commission. SECTION 6. The Van Buren Riding Club will pay a rental of One Dollar ($1.00) per year. SECTION 7. This lease is nut ransfernble. SECTION e. This Ordinance being immediately necess ry to develcp thu Van Buren City Pork and necessary in providing for the immediate preserv-lion of the public peace, health and safety, an Ai emergency is declored to exist and this Ordinance shell be and take effr,ct and be in force after its passoge, approval and publication.
