ORD NO 18-1966 ORDINANCE NO. 18 -1966
wHEREAS, a petition was duly filed with the City Council
of the City of Van Buren, Crawford County, Arkansas, on the 8th
day of November, 1966, asking the City Council to vacate and
abandon all that portion of the alley designated on the plat of
the Oakland Place ~Addition to said City, now appearing of record
in Plat Book One (1), Figure Two (2) Sheet Ten (10), in the Office
of the Recorder of Crawford County, Arkansas; and
'WHEREAS, after due notices as required by law, the Council
has,:at the time and place mentioned in the notice, heard all
persons desiring to be heard on the question and has ascertained
that the alley or the portion thereof, hereinbefore described,
has heretofore been dedicated to the public use as an alley herein
described; has not been actually used by the public generally for
a period of at least five (5) years subsequent to the filing of
the plat; that all the owners of the property abutting upon the
alley; to be vacated have filed with the City Council their written
consent to such abandonment; and that public interest and welfare
will :not be adversely affected by the abandonment of such alley.
NOW THEREFORE, be it ordained by the City Council of the City
of Van Buren, Crawford County, Arkansas:
Suction 1. The City of Van Buren, Arkansas, hereby releases,
vacates and abandons all its rights, together with the rights of
the public generally, in and to the street or alley designated as
follows:
All that portion of the alley located in Dlock
Eight (8) of Oakland Place Addition in the City of
Van Buren, Arkansas, and lying east and west between
.North 17th Street and North 18th Street.
0 .Section 2. h copy of the ordinance duly certified by the
City Clerk shall be filed in the office of the Recorder of the
County and recorded in the deed records of the County.
Section 3. All utility easements affedting this property are
not, and shall not be, applicable to the passage of this Ordinance.
Section 4; This Ordinance shall take effect and be in:force
from and after its passage.
