ORD NO 16-1966 ORDINANCE N0. 16 -1966 WHEREAS, a petition was filed with the City Council of the City of Van Buren, Arkansas on the 19th day of July, 1966, asking the City Council to vacate and abandon all that portion of a certain street located in the City of Van Buren, Arkansas, described as follows: That portion of Lafayette Street lying between Blocks 1 and 2 of the Original Town of Van Buren, Arkansas, lying Southwest of the Missouri Pacific Railroad. WHEREAS, after due notice as required by law, the Council has at the time and place mentioned in the notice heard all. persons desiring to be heard on the question; the Council finds that the Petitioner is the only owner abutting upon that portion of the street to be vacated; thet the public interest and welfare will mot adversely be affected by the abandonment of said street; that that portion of said street to be abandoned has not been opened and used by the public as a street and could not be opened and used and will never be of benefit to the city of Van Buren, Arkansas, and should be abandoned and vacated. 'NCW THEREFORE, DE IT ORDAINED BY the City Council of the City of Van Buren, Arkansas: Section 1. The City of Von Duren, Arkansas, hereby releases, vacates and abandons all its right, together with the rights .of the public generally, in and to: All that portion of Lafayette Street lying between Blocks 1 end 2 of the Original Town of Van Duren, Arkansas, lying Southwest of the Missouri Pacific Rail- road, and from and after this date said property shall be the separate property of Martha Ward Presson; Section 2. A copy of this Ordinance, duly certified by the City Clerk and Town Recorder, shall be filed in the office of the Recorder of the County and recorded in the Deed Records of this County. Section 3. This ordinance shall not affect any utility rights by any public utility as now enjoyed, and any utility right which is now being used upon, over or through subject property shall continue free of any obstructions which would constitute a hazard for such utility operation and maintenance and the right of ingress and egress for such maintenance for so long as the some shall continue to be used. At such time as the same shall cease to be used, such right shall cease. Section 4. This Ordinance shell take effect and be of Force from and after its passage.
