ORD NO 15-1966 ORDINANCE NO. 15 -1966 WHEREAS, a petition was filed with the City Council of the City of Von Buren, Arkansas, on the 19th day of July, 1966, asking the City Council to vacate and abandon all that portion of a cer- tain street loc._ted in the City of Van Buren, Arkansas described as follows: That part of '\Jebster Street lying between Block 7 and Block 6, of the Original Town of Van Buren, Arkansas, lying southwest of South 3rd Street end North of the Missouri Pacific Railroad. WHEREAS, after due notice as required by law, the Council has at the time and place mentioned in the notice heard all persons desiring to be heard on the question; the Council finds that'the Petitioner is the only owner abutting upon that portion of the street to be vacated; that the public interest and welfare will not adversely be affected by the abandonment of said street; that that portion of said street to be abandoned has not been opened end used by the public as a street end could not be opened and used and will never be of benefit to the City of Van Buren, Arkansas, and should be obanduned and vacated. NOW, THEREFORE, BE IT ORDAINED BY the City Council of Van Buren, Arkansas: SECTION I. Thu City of Van Buren, Arkansas, hereby releases, vacates and ab•rndons ell its right, together with the rights of the public generally in and to: That part of Webster Street lying Between Block 7 and .Block 6, of thu Original Twon of Van Buren, Arkansas, lying southwest of South 3rd Street and North of the Missouri Pacific Railroad, and from and after this dote said property shall be the separate property of Derrell T. Thomas and Louise E. Thomas. SECTION II. A copy of this Ordinance, duly certified by the City Clerk and Town Recorder, shall be filed in the office of the recorder of the County and recorded in the Deed Records of this County. SECTION III. This ordinance shall not affect any utility. rights:by eny public utility as now enjoyed, and any utility right which is now being used upon, over or through subject property shall continue free of any obstructions which would constitute a hazard for such utility operation and maintanence and the right of ingress and egress for such maintenance for so long as the same shall cease to be used, such right shall cease.
