ORD NO 05-1966 ORDINANCE NO. 5 -1966
WHEREAS, a petition was filed with the City Council of the
City of Van Buren, Arkansas on the 14th day of March, 1966, asking
the City Council to vacate and ab;ndcn all that portion of o certain
street located in the City of Van Buren, Arkansas, described as
follows:
All that portion of Y)ebster Street lying between
Lot 8 in Block 5 and Lot 1 in Block 4; extends
from Water Street to the alley in Block 4 and
Block 5, all in the Original Town of Van Buren,
Arkansas
WHEREAS, after due notice as required by law, the Council
has at the time and placd mentioned in the notice heard all persons
desiring to be heard on the question; the Council finds that the
Petitioner is the only owner abutting upon that portion of the
street to be vacated; that the public interest and welfare will
not adversely be affected by the abandonment of said street; that
that portion of said street to be abandoned has not been opened
and used by the public as o street and could not be opened and
used and will never be of benefit to the city of Von Buren,
Arkansas, end should be abandoned and vacated.
'NOW, THEREFORE, BE IT ORDAIiNED by the City Council of the
City of Van Buren, Arkansas:
SECTION I. The City of Van Buren, Arkansas, hereby releases,
vacates and abandons all its right, together with the rights of
the public generally, in and to;
All that portion of Webster Street lying between Lot
8 in Block 5 and Lot 1 in Block 4; extends from Water
Street to the alley in Block 4 and Block 5; all in
the original town of Von Buren, Arkansas.
and from and after this date said property shall be the separate
property of Martha 'Word Presson;
SECTION II. A copy of this Ordinance, duly certified by the
City Clerk and Town Recorder, shall be filed in the office of the
Recorder of the County and recorded in the Deed Records of this
County.

SECTION III. This ordinance shall not affect any utility
rights by any public utility as now enjoyed, and any utility right
which is now being used upon'; over or through subject property
shall continue free of any obstructions which would constitute
a hazard for such utility operation and maintenance and the right
of ingress and egress for such maintenance for so long as the
same shall continue to be used. At such time as the same shall
cease to be used, such right shall cease.
SECTION IV. This ordinance shall take effect odd be of force
from and after its passage.
