ORD NO 03-1966 ORDINANCE NO. 3 -1966 WHEREAS, a Petition was duly filed with the City Council of the City of Van Buren, Arkansas, an the 3rd day of January, 1966, asking the City Cuuncil to vacate and abandon alltthat portion of curtain streets,.located in the City of Van Buren, Arkansas, described as follows: That portion of Elm Strat lying East of llth Streut and West of 12th Street, the same lying immediately North of Block 6 and South of Block 7 McGee Addition to the City of Van Buren, Arkansas; WHEREAS, after due nuticd as required by law, the Council has at the time and place mentioned in the Notice heard all persons desiring to be heard on the question; That the Petitioners are the only owners abutting upon that portion of said streets to be vacated; That the public interest and welfare will not adversely be affected by the abandonment of said street, and that the Van Buren Public School District No. 42 will be in a position by reason of such abandonment to grec.tly enhance their facilities of thier various properties and provide a better physical plant from which the entire City of Van Buren will benefit. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Van Buren, Arkansas: SECTION I. The City of Van Duren, Arkansas, hereby releases vacates, and abandons all its right, tothether with the rights of the public generally in and to that portion of Elm Street lying East of llth Street and West of 12th Streut and lying immediately South of Block 7 and North of Block 6 in McGee Addition to the City of Van Buren, Arkansas, and that from and after this date said property shall be the separate property of the Van Buren School District No. 42. SECTION II.i, A copy of this Ordinance, dw$:y certified by th City Clerk and Town Recorder, shall be filed in the office of the Recorder of the County and recorded in the Deed Rebords of this County. SECTION III. This ordinance shall not affect any utility rights by any public utility as now enjoyed, and any utility right which is now being used upon, over or thruugh subject property shall continue free of any obstruction which would constitute a hazard for such utility operation and maintenance and the right of ingress and egress for such maintenance for so'long as the same shall continue to be used. At such time as the same shall cease to he used, such right shall cease. SECTION HIV. This Ordinance shall take effect and be of force from and after its passage.
