ORDINANCE NO.12 -1967
AN ORDINANCE ;;MENDING ORDINANCE NO. 7 -1963 TO AMEND ARTICLE
VII, SECTION 2, PARAGRAPH 2, TO PROVIDE A GUIDE FOR STRUCTURES IN
RESIDENTIAL ZONES THAT DO NOT CONFORM TO NORMAL AND USUALLY FOUND
0 STRUCTURES IN THE RESIDENTIAL AREA.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS.
SECTIDN.I. Article VII,.Section 2, paragraph 2 cf Ordinance
Nu. 7 -1963 the Zoning Ordinance is hereby amended by adding a
sub paragraph as following;
(d) No building permit shall be issued for any
structures (principal or accessory) that is of a
size, shape, design or use that dues net conform
to normal and usually fuund structures in the
residential arca where the permit is requested
until reviewed by the Zuning Committee who may:
(d -1) Recommend that the Building I
issue a building permit if the Committee finds
the intent of the Ordinances is complied with and
the structures will not be objectionable to the
future use of the zoned area.
(d -2) Recommend that the Building Inspector
not issue a building permit if the Committee finds
the intent of the Ordinances is not complied with
and the structure will be objectionable to the
future use of the zoned area.
(d -3) May recommend that the request be treated
as a variance, with steps under Article VIII,
Section 2 and 3 of the Zuning Ordinance ba
followed and then a reccmmendatiun be made to the
Van Buren City Council setting as a Board of
Adjustment whether such variance should be granted.
SECTION II. That by reason of the immediate necessity of
protedting the community an emergency is hereby declared to exist,
and this ordinance being necessary fur the immediate preservation
of the public peace, health and safety shall take effect and be in
furce• from and after its passage, approval and publication.
