ORD NO 28-2009 CITY OF VAN BUREN, ARKANSAS ORDINANCE NOc?g -2009 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE POLICE CAR VIDEO UPGRADE EQUIPMENT FROM WATCH GUARD VIDEO, FOR THE POLICE DEPARTMENT, WAIVING BIDDING REQUIREMENTS, AND FOR OTHER PURPOSES. WHEREAS, the Police Department requires specific upgraded video equipment, for certain police vehicles, to integrate with an existing proprietary system from Watch Guard Digital In -Car Video; and WHEREAS, the City of Van Buren Police Department wishes to purchase specific in -car video, of the type set forth in the invoice attached hereto as Exhibit "A "from Watch Guard Video of Dallas. Texas; and WHEREAS, the City is authorized to waive the expense and time of bidding to purchase such equipment, were it would be impracticable and unfeasible to bid the equipment herein pursuant to state bidding requirements, and there is no potential for savings to the city to let bids on said propriety equipment and the City needs to immediately begin installing the upgraded in -car video equipment without any delays or any further action by the City Council; and WHEREAS, Section 14 -58 -303 of the ARKANSAS CODE ANNOTATED provides that "The governing body, by Ordinance, may waive the requirements of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical." NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: The City Council hereby waives the requirements of competitive bidding for the above described video equipment, as such a procedure is not deemed to be feasible or practical under the circumstances, specifically the need for proprietary equipment to work with the Police Department's existing system. SECTION 2: The Mayor and City Clerk are hereby authorized to purchase the 3r Generation D1 -10 consoles and accessories, from Watch Guard Video, as set out in Exhibit "A," and to expend up to sixteen thousand, two hundred and sixty -four dollars and 80/100 ($16,264.80), out of public safety funds to effectuate this ordinance. IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass, approve, and adopt, by a vote of (o for and 0 against, the foregoing Ordinance at its Regular Meeting held on the 19' day of October 2009.
