ORD NO 17-2009 CITY OF VAN BUREN, ARKANSAS
ORDINANCE NO. i'7 -2009
BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND VAN BUREN'S ZONING
REGULATIONS, ORDINANCE NO. 07 -1963 (as amended);
DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.
WHEREAS, upon a review of certain provisions of Van Buren's Zoning Ordinance No 07 -1963
(as amended), pertaining to R -3 Zoning, by the Van Buren Planning Department and
the Planning Commission, the Commission has recommended certain revisions
pertaining to building setoffs for fire safety purposes; and
WHEREAS, notice of a Public Hearing was duly published, and a Public hearing was conducted
by the Van Buren Planning Commission to consider revisions thereto; and
WHEREAS, the proposed amendments to the Van Buren Municipal Code herein were
recommended by a majority vote of the entire Planning Commission;
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
THE CITY OF VAN BUREN, ARKANSAS, THAT:
SECTION 1: Article V, Section 3. of Ordinance No. 07 -1963, as amended, (see Van Buren
Municipal Code 14.04.01 el al) is amended as follows to add the following
subsection:
e. Building Separation: There shall he a minimum of 20'
of separation between buildings constructed on the
same lot.
SECTION 2: The passage and approval of these amendments to the Van Buren Zoning Ordinance
will make the Zoning regulations more responsive to fire safety issues and therefore,
an emergency is declared to exist and this Ordinance, being necessary for the
preservation of the public peace, health and safety, shall be in full force and take
effect immediately upon and after its passage.
SECTION 3: The various provisions and parts of this Ordinance are hereby declared to be
severable, and, if any section or part of a section, or any provision or part of a
provision herein, is declared to be unconstitutional, inappropriate, or invalid by any
court of competent jurisdiction, such holding shall not invalidate or affect the
remainder of this Ordinance and to that extent the provisions hereto are declared to
be severable.
IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass,
approve, and adopt, by a vote of 4, for and 0 against, the foregoing Ordinance at its meeting
held on the 21 st day of September 2009.
