CITY ORDINANCE NO. 1 vZ
WHEREAS, a Petition was filed with the City Council of the
City of Van Buren, Arkansas, on the day of January, 1972, 'ask-
ing the City Council to vacate, close and abandon all that portion of
a certain street located in ,Van Buren, Arkansas, more particularly
described as follows:
That part. of Summit Street lying between Block "0"
and Block "E" of Mountain View Addition to the City
of Van Buren, Crawford County, Arkansas.
WHEREAS, after due Notice as required by law, the Council
has at the time and place mentioned in said Notice heard all persons
desiring to be heard on the question; the Council finds that the Petition-
ers are the only owners of property abutting upon the portion of said
street to be vacated and closed; that the public interest and welfare
will not be adversely affected by the abandonment of said street; that

said street to be vacated and abandoned has not been opened and used
b y the public as a street and could not be opened and used and will
never be of benefit to the City of Van Buren, Arkansas, and should
i 0 be abandoned and vacated.
NOW, THEREFORE, BE IT ORDAINED by the City Council. of
Van Buren, Arkansas:
SECTION 1. The City of Van Buren, Arkansas, hereby releases,
vacates and abandons all of its right, together with the rights of the

public generally in and to:
That part of Summit Street lying between Block
"0" and Block "E" of Mountain View Addition
to the City of Van Buren, Crawford County, Ark-
ansas
and from and after this date said property shall be the separate
property of the Petitioners, Samuel Arthur Yerby, Edith May Yerby
and Rex LeRoy Yerby.
SECTION II. A copy of this Ordinance, duly certified by
the City Clerk and Town Recorder, shall be filed in the office of
the Recorder of the County and recorded in the Deed Records of this
County.
SECTION III. This Ordinance shall not affect any utility rights
now enjoyed by any public utility company, and any utility right which
is now being used upon, over or through subject property shall con-
tinue free of any obstructions which would constitute a hazard for
such utility operation and maintenance and the right of ingress or
egress for such maintenance for so long as the same shall continue
to be used. At such time as the same shall cease to be used, such
right shall cease.
SECTION IV. This Ordinance shall take effect and be of force
from and after its passage.
