AN ORDINANCE TO BE ENTITLED: AN ORDINANCE FOR THE BETTER PROTECTION
OF THE HEALTHkOF CITYeOF VAN BUREN, ARKANSAS BY ADOPTING CERTAIN
RULES AND PROVIDING FOR`TESTS FOR ALL PERSONS ENGAGED IN FOOD SERVICE
OR HANDLING OPEN FOOD OR DRINKS WHICH ARE MANUFACTURED, PROCESSED, SOLD,
OR OFFERED FOR SALE IN THE CITY OF VAN BUREN, AND PROVIDING PENALTY FOR
VIOLATION OF SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,
ARKANSAS'
SECTION 1: It shall be unlawful for any person to engage in food
services or handling of open food in any hotel, cafeteria, resturant,
lunch counter, soft drink stand, soda fountain, ice cream factory, milk
depot, or in any dairy or milk bottling plant, or in any bottling plant
of etherplace where water or beverages are bottled for distribution or
sale, or any ice plant, pop corn stand, cnady stand, cream station, bakery,
grocery store, meat market, meat or poultry processing plant nursing home,
and any other place offering open food or beverages for sale to the :public
unless said person has been issued a food handlers permit by the Crawford
County Health Unit as herein after provided.
SECTION 2: That after the passage and publication of this Ordinance
every person referred to and defined in Sectional, above, shall, before
engaging in any such food services, present himself, or herself to the
Crawford County Health Unit for tests for any communicable diseases,
and if tests on said person be found satisfactory, a food handlers permit
will be issued. These permits must be renewed once each year, 1st of
January, to be completed within 30 days after the date due, as long as
such person engaged in any of the. activities, or employment defined
in Section 1.
.SECTION 3: To defray the actual cost and expense of making the
tests provided for in Section 2 of this Ordinance, each applicant ,at the
time of presenting himself or herself for tests shall pay a fee of!$2.00
to the Crawford County Health Unit. The money collected shall be paid
and deposited to the credit of the Health Unit Fund, of such Crawford
County Health Unit.
'SECTION 4: Any person working during the Crawford County and or
Fort Smith Fair will be issued a Temporary Permit lasting for,30 days
for fee of $1.00.

SECTION 5: That it shall be unlawful for any person, or firm,
or corporation to employ or permit any person to engage in any food
service or activities referred to in Section 1, of this Ordinance,
who has not been issued a food handlers permit by the Crawford
County Health Unit. The employer shall keep these permits available
for inspection by the Crawford County Health Unit or by any police
officer of the City of Van Buren, Arkansas.
SECTION 6: That any person failing to comply with the require-
ments of or violating any part of this Ordinance shall be deemed
guilty of a misdemeanor and upon conviction in the Municipal Court
of the City of Van Buren, Arkansas shall be fined no less than
Twenty -five (525.00) Dollars nor more than Fifty (550.00) Dollars
and each day constitute a separate offense.
SECTION 7: That it is the desire of the City Council of the
City of Van Buren, Arkansas that the Crawford County Health Unit
inspect each and every eating establishment at least once each
month to insure compliance with all Health Laws.
SECTION 8: That by reason of the immediate neccessity of
protecting the health of the inhabitants of the City of Van Buren,
Arkansas, an emergency is declared to exist, and this Ordinance
being necessary for an immediate preservation of the public health
and safety, shall take effect and be in force from and after its
passage, approval, and publication.
