ORD NO 28-1975 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 28 -1975 AN ORDINANCE TO AMEND ORDINANCE NO. 30 -1974, TO PROVIDE FOR A PRIVILEGE LICENSE }1, FEE FOR GARAGE SALE, PORCH SALE, RUMMAGE SALE, OR SIMILIAR TYPE SALE. BE IT ORDAINED AND ENACTED by the City Council of the City of Van Buren, Arkansas, that: 1. Ordinance No. 30 -1974, as amended, the Privilege License Ordinance of the City.of;Van Buren, be and it is hereby amended by adding the following as Section XIII of that Ordinance: SECTION XIII -A. It shall be unlawful for any person, firm, or corporation within the City of Van Buren to engage in or carry on any garage sale, porch sale, rummage sale, or any similiar type sale unless that person, firm or corporation FIRST obtains from the City Clerk a permit to do so, and signs an affidavit that said sale shall be of personal property owned by said person, firm or corporation, and that said property was NOT purchased for the purpose of resale. The City Clerk shall make, and collect, a charge of $5.00 per day for all permits for such sale, except as is hereinafter provided. The City Clerk shall issue, without charge and without any type of time limitation, a permit for any such sale being conducted by Church or being conducted for any generally recognized charitable purpose. If any person, firm or corporation, other than a church or persons con- ducting a sale for a generally recognized charitable purpose, shall, at the time of applying for said permit, sign the above affidavit and has not con- ducted a garage sale, porch sale, rummage sale, or similiar sale the prior six months, as provided below, the City Clerk shall issue, without charge, a permit for said, sale to continue for a period of time no longer that/three days, provided the City Clerk shall NOT issue two such permits as are suthor- ized in this paragraph, without cost to any one person, firm or corporation, or to any person who has obtained a prior permit without cost for a sale within the immediately preceding six month period, nor shall the City Clerk issue a second such permit authorized by this paragraph where the first permit was issued without cost. No signs advertising said sale will be placed on utility poles, trees, street right of way and no such signs will be placed upon private property without signed authorization by the owner of said private property. Any said sign put up will be removed within 24 hours after termination of sale. SECTION XIII -C. The provision of Ordinance No. 11 -1963 pertaining to rummage sales shall apply to all sales authorized by this Ordinance. 2. That due to the need to make our privilege licenses more uniform, an emergency therefore is declared and the Ordinance being necessary for the preservation of the public peace, health and safety, ahall be in full force and effect from and after its passage, approval and publication.
