ORD NO 18-1975 ORDINANCE NO. /7- 1975
WHEREAS, a petition was duly filed with the City Council of the City of Van
A
Buren, Arkansas, on the L( day of May, 1975, asking the City Council to vacate,
and abandon all portion of a certain street and alley located in the City of Van
Buren, Arkansas, described as follows:
That part of 6th street between Block 61 and Block 70, and the alley in Block
61, of the Original Town of Van Buren, Arkansas.
WHEREAS, after due notice as required by law, the City Council has at the time
and place mentioned, ascertained that the portion of said street and alley hereinbe-
fore been designated to the public use and that the Petitioner is the only owner
abutting upon the portion to be vacated; and the public interest and welfare will
not be adversely effected by the abandonment of said street and alley.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF VAN BUREN, ARKANSAS:
SECTION 1. The City of Van Buren, Arkansas, hereby releases, vacates, and
abandons all its rights, together with the rights of the general public, to that
portion of 6th street between Block 61 and Block 70 and the alley in Block 61, of
the Original Town of Van Buren, Arkansas, and that from and after this date said
property shall be the separate property of Orville A. Riddle.
SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall
be filed,' the:deeds_of5 Crawford County.
SECTION 3. This Ordinance shall not effect any utility rights by any public
utility as not enjoined, and any utility right which is now being used upon, over,
or through said property shall continue free of any obstructions which would con-
stitute a hazard for such utility operation, maintenances, and the right of ingress
and egress for such maintenance for so long as the same shall continue to be used.
At such time as the same shall cease to be used, such right shall cease.
SECTION 4. This Ordinance shall take effect and be in force from and after
its passage.
