ORD NO 12-1975 CITY OF VAN BUREN, ARKANSAS Ordinance No 1 .197.5. AN ORDINANCE AMENDING ORDINANCE No. 7 -1963, as amended, to AMEND ARTICLE III SECTION 1, TO ADD AND OPEN AREA ZONE "0 -1 to AMEND ARTICLE IV SECTION 5 ZONING DF ANNEXED TERRITORY AND TO AMEND ARTICLE V SECTION 9m0PEN AREA ZONE "0 -1 NOW THEREFORE BE IT ORDAINED 3Y THE CITY CLUNCIL OF THE CITY OF VAN BUREN, ARKANSAS. 1. That Article III Section 1 of Ordinance No. 7 -1963, as amended, is amended by adding a new zone classification after I -2 Heavy indust- rial district, to Wit: 0 -1 Open Area Zone. II. That Article IV, Section 5, of Ordinance No. 7 -1963, as amended, is amended to read as following: SECTION 5. ZONING OF ANNEXED TERRITORY All territory which may hereafter be annexed to the City shall be classified into a zone, or several zones, according to one of the following procedures at the time of annexation: 1. Undeveloped tracts shall be classified in an open zone district unless the owners thereof request otherwish or the Planning Commission makes a study of the area and determines the appropriate zoning class- ifications which will be consistent with the Comprehensive Plan. 2. Developed areas or tracts of land where development is underway shall be classified according to existing uses which are established, or being established, at the time of annexation unless the owners request otherwise, or the Planning Commision makes a study of the area and determines that other zoning classifications are required. 3. Territory being annexed to the City shall be classified into a zone, or zones, in accordance with the requests of owners of the area unless the Planning Commision determines that the requests are not in the best interests of the City, in which case the area shall be classified in an open tone. 4. The proposed zoning classification of territory being annexed into the City in accordance to any provision of this Section shall be presented at a public hearing before the Planning ommision makes its recommendation to the City 'ouncil. III. That Article V, Section 9 of Ordinance 7 -1963, ao amended, is amended is amended by adding a Section 9 as following: SECTION 9: Open Area Zone "0 -1 A. Purpose: A zone to protect undeveloped, or developing areas, after annexation into the C ity, until a request for re- zoning is approved or until the City acts to re -zone part, or all, of the area. B. Permitted Uses: In addition to allowing existing uses to continue that are not detrimental to public health, safety and general welfare, the follow- ing uses are permitted: (Amendment of Ordinance No. 7 -1963/ Page 2 1. Single Family Dwellings. 2. Public Facilities and Utilities. 3. Recreation Facilities. 4. Agricultural Uses, excluding Feeding or Processing type uses. 5. Accessory Uses to a Permitted Use. 6. All Other Uses are Prohibited. C. Development Standards: The following minimum standards are established for uses in the "0 -1" zone: 1. Minimum Lot Area 6 Acres 2. Minimum Lot Width 300 ft. 3. Minimum Building Setback From Property Line 50 ft. 4. Maximum Lot Coverage by Buildings 10`/0. 5. Off- Street Parking Adequate for Permitted Use. IV. It being immediately necessary for the preservation of the peace, health and safety of Van "uren, Arkansas, and the inhabitants thereof, that the provision of this Ordinance shall take effect and be in full force from,and after, its passage, approval and publication. rr11'' o PASSED AND APPROVED THIS !t DAY OF Vk AAu1 1975.
