ORD NO 06-1975 ORDINANCE NO. 6 c75 WHEREAS A PETITION WAS DULY FILED WITH THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS by Robert D. Quillin and Virginia R. Randolph, on the 13th day of January, 1975; praying and requesting the City Council of the City of Van Buren, Arkansas to vacate and abandon all that portion of Fourteenth Street, from Elm Street North to Poplar Street; excluding the north ten feet (10') adjoining Poplar Street in the City of Van Buren, Arkansas; and WHEREAS, after due notice as required by law, the City Council of Van Buren, Arkansas, has at the time and place, set forth in the notice, heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described has not been open and no crossing has been maintained at the St. Louis San Francisco Railroad Company on said Fourteenth Street for more than five (5) years, and the same has not been used generally by the public; that all the owners of the property abutting upon the portion of the street to be vacated have filed with. the City Council of Van Buren, Arkansas, their written consent to such abandonment and that the public interest and welfare will not be adversely affected by the abandonment of such street. NOW THEREFORE BE IT ORDAINED BY the City Council of the City of Van Buren, Arkansas: SECTION I. The City of Van Buren, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, SUBJECT HOWEVER, to any and all rights of any public utility, with reasonable rights of ingress and egress for the purpose of repairing, replacing, maintaining, removing or improving any existing public utility, whether the same be publicly or privately owned, in and to the street designated as follows: Fourteenth Street from Elm Street North, to Poplar Street; excluding the north ten feet (10')• adjoining Poplar Street. Giving to Robert D. Quillin and Virginia R. Randolph the west thirty (30) feet and giving to the St. Louis -San Francisco Railway Company the east thirty (30) feet. SECTION II. A copy of the Ordinance duly certified. by the City Clerk shall be filed in the office of the recorder of Crawford County, Arkansas, and recorded in the deed records of the County. d SECTION III.
