06 June 2013 Regular MINUTES OF THE VAN BUREN, ARKANSAS CITY COUNCIL MEETING JUNE 17, 2013 The City Council of the City of Van Buren, Arkansas met at 7:00 p.m. Monday, June 17, 2013 at City Hall. The meeting was called to order by Mayor Freeman. On roll call, the following Council members answered as their names were called: Alderman Parker, Blake, Moore, Ragsdale, Dodd and Sagely. City Clerk- Treasurer Barbie Curtis and City Attorney Candice Settle were present. This made a total of nine (9) present. A quorum was declared. The invocation was given by Alonso Monterroza, Deacon of Iglesia Bautista Hispana Getsemani. Next, Mayor Freeman led the Pledge of Allegiance. On the agenda next, Mayor Freeman asked to adopt the minutes of the Council Meeting on May 20, 2013. Alderman Parker made a motion to approve the minutes. Alderman Ragsdale seconded the motion. On roll call, the following Council members voted aye: Alderman Ragsdale, Dodd, Sagely, Parker, Blake and Moore. The following voted nay: none. On the agenda next was to consider A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO REMOVE AND DISPOSE OF CERTAIN FIXED ASSETS FROM THE CITY OF VAN BUREN'S FIXED ASSET INVENTORY, BY SEALED BID, AUCTION OR OTHER METHODS AUTHORIZED UNDER THE LAW, AND FOR OTHER PURPOSES. The Clerk read the Resolution in its entirety. Mayor Freeman asked if there was any discussion. Mayor Freeman noted that these items would be sold in the next annual police department sale. Alderman Dodd seconded by Alderman Sagely moved that the Resolution be adopted. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Ragsdale, Dodd, Sagely, Parker, Blake and Moore. Nays none. The Mayor thereupon declared the Resolution adopted and signed the Resolution, which was attested by the City Clerk and impressed with the seal of the City. WHEREAS, the City of Van Buren has certain fixed assets on its Fixed Asset Inventory List which are obsolete, and/or beyond repair, and are no longer cost effective, so as to no longer be needed by the City; and WHEREAS, after an inventory of fixed assets, it is therefore recommended by our State Auditor that said items or item be removed from the City's Fixed Asset Inventory and disposed of by sealed bid, auction or as otherwise authorized under Arkansas law. FOR THE 16 STREET AND POINTER TRAIL TRAFFIC SIGNALIZATION AND IMPROVEMENT PROJECT, AND FOR OTHER PURPOSES. The Clerk read the Resolution in its entirety. Mayor Freeman asked if there was any discussion. Mayor Freeman showed the council several photos of the area and mentioned that one exit of the tennis courts and Heritage Church will be closed for safety reasons. He also said this project will include the overlay and widening of the surrounding area. Alderman Sagely questioned whether there will still be parking in front of the tennis courts. Mayor Freeman replied yes and that just one entrance will be closed to ease traffic flow. Mayor Freeman estimated that it would be a sixty day project beginning approximately July lst and ending sometime around the end of August. He stated that it would run into school starting, so there will be some juggling expected with that. Alderman Ragsdale seconded by Alderman Parker moved that the Resolution be adopted. FOR THE 16 STREET AND POINTER TRAIL TRAFFIC SIGNALIZATION AND IMPROVEMENT PROJECT, AND FOR OTHER PURPOSES. WHEREAS, McClelland Consulting Engineers, Inc. acting on behalf of the City of Van Buren has advertised for bids for the 16 Street and Pointer Trail Traffic Signalization and Improvement Project; and WHEREAS, bids have been received and opened in accordance with Arkansas law and TNT, Inc. was the lowest bidder meeting the bid specifications; and WHEREAS, the City of Van Buren has determined that the bid of 624,956.01, is the best bid NOW, THEREFORE, BE IT RESOLVED BY 1HE CITY COUNCIL OF VAN BUREN, ARKANSAS, THAT: SECTION 1: The City of Van Buren, Arkansas accepts the bid of 624,956.01 as submitted by TNT, Inc. as set forth in "Exhibit A" attached hereto. SECTION 2: The Mayor is further authorized to enter into an agreement with an appropriate financial institution in order to finance payment of this project, pursuant to AMENDMENT 78, SECTION 2 OF THE CONSTITUTION OF THE STATE OF ARKANSAS and ARK. City Attorney, Candice Settle, reviewed the agreement and the Van Buren School Board approved it at their last board meeting. Alderman Dodd seconded by Alderman Blake moved that the Resolution be adopted. THE RESOLUTION WAS GIVEN THE NUMBER 6 -3 -2013 CITY OF VAN BUREN, ARKANSAS RESOLUTION NO. 2013 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, A RESOLUTION TO BE ENTITLED: A RESOLUTION TO ENTER INTO A COOPERATIVE AGREEMENT WITH THE VAN BUREN PUBLIC SCHOOL DISTRICT. WHEREAS, it is the intention of the Van Buren Police Department and the Van Buren School District to maintain collaborative efforts to provide a safe and healthy school environment for the students, staff, faculty, and visitors. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN, ARKANSAS, THAT: SECTION 1: The City Council hereby authorizes the Van Buren Police Department, through its Chief of Police, to enter into the attached Cooperative Agreement with the Van Buren Public School District for the providing and funding of School Resource Officers within the Van Buren Public Schools. Fr= or AT ESTED: D 0 RM: Barbie Curtis Candice A. ettle City Clerk/Treasurer City Attorney On the agenda next was to consider AN ORDINANCE TO PROVIDE REGULATIONS FOR THE PARKING OF COMMERCIAL VEHICLES ON RESIDENTIAL STREETS AND PROPERTIES; AND FOR OTHER PURPOSES. The City Clerk read the Ordinance in its entirety. Alderman Ragsdale moved that the rules be suspended and the Ordinance be placed on its second reading. The motion was seconded by Alderman Parker. The council followed with a unanimous vote. The City Clerk then read the Ordinance the second time. Alderman Ragsdale moved that the rules be further suspended and the Ordinance placed on the third and final reading. The motion was seconded by Alderman Sagely. The council followed with a unanimous vote. The City Clerk then read the Ordinance the third and final time. The Mayor asked if there was any discussion. Mayor Freeman mentioned that interest was shown by Alderman Ragsdale to move forward with action on this issue after several months of discussion at prior council meetings. This ordinance was drafted by our City Attorney, Candice Settle. Alderman Dodd asked if this meant they could not park anywhere on their private property (i.e. backyard, driveway, yard). Mayor Freeman replied, no, that this ordinance meant they could not park in the street or in a city right -of -way. Alderman Dodd clarified her question and City Attorney, Candice Settle, explained that it would pertain to any property zoned residential whether privately or city owned. Alderman Blake raised an issue with current owners who have built driveways and structures specifically for their commercial grade vehicles. Mayor Freeman reiterated that this would still apply to them. Alderman Blake questioned where they are to park their vehicles. Alderman Dodd replied that they'd have to rent a storage space just like she does for her equipment. City Attorney, Candice Settle, stated that there is a good point to be made regarding weight limits on city streets and the damage it incurs by constant usage of large vehicles. Alderman Sagely made the point that this will really only effect about 1 -2% of our residents. Mayor Freeman also stated that this does not include recreational vehicles or school buses as of right now. Alderman Parker thinks the school buses need to be addressed with the school district. Alderman Parker also asked about warning residents about the change. Mayor Freeman stated that this ordinance does not have an emergency clause therefore will not go into immediate effect. He will get with Chief Bell about sending out warnings. City Clerk, Barbie Curtis, said that this ordinance will be published in the Press Argus newspaper and it will go into effect ninety (90) days after its publication. The Mayor then put the question, "Shall the Ordinance pass Motion was made by Alderman Ragsdale and seconded by Alderman Dodd to adopt the Ordinance. THE ORDINANCE WAS GIVEN THE NUMBER 4 -2013 ORDINANCE NUMBER 4 -2013 CONTINUED CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 4- 2013 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO PROVIDE REGULATIONS FOR THE PARKING OF COMMERICAL VEHICLES ON RESI- DENTIAL STREETS AND PROPERTIES; AND FOR OTHER PURPOSES. WHEREAS, the City Council has determined that it 15 in the best interests of the citizens of the City of Van Buren, Arkansas that certain commercial vehicles be prevented from parking on residential streets except in the normal course of deliveries or other special op- erations, to prevent excessive damage to roadways, to prevent dangers to drivers resulting from blocked streets, and for other reasons. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION 1: Restricted Parking. It shall be unlawful to park or leave parked, standing, or unattended any commercial vehicle on any street or right -of -way classified as residential or as a residential collector or on any property zoned residential or developed or utilized for residential purposes. SECTION 2: Commercial Vehicles Defined. (a) Any solid waste collection vehicle, truck tractor, truck trailer, or tractor truck/trailer combination,, any heavy construction equipment, dump truck, con -I crete mixer truck, garbage truck, pump -out truck, chemical /gasoline truck, fuel or oil truck, or similar vehicle designed to transport waste, hazardous, or noxious materials; (b) Any vehicle with three or more axles; (c) Any commercial vehicle that has a gross vehicle weight rating (GVWR) greater than 16,000 pounds; or (d) Any box or straight truck that has a gross vehicle weight rating (GVWR) greater than 10,000 pounds. A box or straight truck is one that has a high cubic feet of storage volume with a box or storage container built onto the chassis typically used for hauling appli- ances, furniture or other cargo. Familiar terms used to describe box or straight trucks include cargo trucks, container trucks and moving trucks. SECTION 3: Exceptions. The provisions of this section shall not apply to any commercial vehicle while mak- ing normal deliveries or being used to perform the special operations for which it is designed. SECTION 4: Penalties. Violations of the provisions of this ordinance will be subject to fines of no more than Two Hundred Fifty Dollars ($250.00). Each oc- currence constitutes a separate violation of this ordi- nance. SECTION 5: Severabilitv. The various provisions and parts of this Ordinance are hereby declared to be severable, and if any section or part of a section, or any provision or part of a provision herein, is de- clared to be unconstitutional, inappropriate, or inva- lid by any court of competent jurisdiction, such hold- ing shall not invalidate or affect the remainder of this Ordinance and to that extent the provisions hereto are declared to be severable.
