ORD NO 47-1976 ORDINANCE NO. 7-/
AN ORDINANCE FIXING RATES FOR THE SALE OF WATER, REPEALING
ORDINANCES IN CONFLICT THEREWITH AND FOR OTHER PURPOSES.
WHEREAS, the cost of operating the Van Buren Water and
Sewer system has increased beyond the revenues collected; and
WHEREAS, the City of Van Buren is obligated to the pay-
ment of bonded indebtedness for construction of improvements
and betterments to the system and the cost thereof and the
cost of operating the water system makes it necessary that
such raise in rates be passed on to its customers; and,
WHEREAS, it is necessary for the City Council of the City
of Van Buren, Arkansas, to establish monthly minimum charge
for the sale of water and fix the cost of water sold in addi-
tion to the amount included in the minimum;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN, ARKANSAS:
Section 1. That the following monthly rates for each
customer connected to and served by the water system of the
City of Van Buren, Arkansas, be charged and billed for water
delivered and metered to them according to the following monthly
rates which the Council finds and determines are reasonable and
necessary rates to be charged;
First 1,000 Gallons (or minimum) 2.80 each fl gal.
Next 4,000 Gallons 1.24
Next 5,000 Gallons .98
Next 90,000 Gallons .65
All over 100,000 Gallons .46
Water for resale .38
All water users outside the city limits of the City of
Van Buren, Arkansas, shall pay one and one -half times
the rate for customers inside the city limits with a
monthly minimum of $4.23 for the first 1,000 gallons or
less.
Section 2. The City Council hereby finds that said rates
which amount to an increase of approximately 30% over the exist-
ing rates, are reasonable and necessary to be charged for monthly
water services, and it is necessary that same be charged and
collected in order to produce sufficient revenue to pay out-
standing bonds and interest thereon as they mature, the cost of
water purchased from the City of Fort Smith, or produced by the
IIP City of Van Buren, Arkansas, and together with the cost of the
operation of the system.
Section 3. All ordinances and part of ordinances in con-
flict herewith are hereby repealed.
Section 4. It is ascertained and declared that there is
immediate need in order to procure approved water and to pro-
tect the health, lives and property of the inhabitants of the
City of Van Buren, Arkansas, to charge and collect the rates
hereinabove set out; therefore, an emergency is found to exist,
that this ordinance is necessary. for the preservation of the
public peace, health and safety, same shall take effect and
be in force without delay, and the same shall be charged
against all water sold and delivered after e4_, /,r- ,1976.
