ORD NO 43-1976 CITY OF VAN BUREN, ARKANSAS
ORDINANCE L -1976
AN ORDINANCE TO PROVIDE FOR CONTROLLED BURNING IN RESIDENTIAL ZONES OF THE CITY
OF VAN BUREN, ARKANSAS: PRIMA FACIE EVIDENCE, REPLACING CONFLICTING LAWS, AND
DECLARING THAT AN EMERGENCY EXISTS.
SECTION 1. It shall be unlawful for any Person to burn any garbage,
rubbish or solid wast in any are of the City zoned "Residential" in the Zoning
Ordinance of the City of Van Buren, Arkansas, except under the following
conditions.
a. It shall be the duty of the person burning to control, at ALL times.
b. That said burning be done in a boiler, furnace, incinerator or refuse
burner constructed with a screen wire as a spark arrester.
c. Leaves brush and tree limbs may be burned upon the ground PROVIDED
there is no wind and provided said fire is not closer than Twenty -five
(25) feet from a structure, and provided no one burns in the street
or upon any City right -of -way.
d. That all burning shall be supervised by a responsible person, or persons,
who will either have a fire extinguisher or water hose with which to
extinguish said boiler, furnace, incinerator or refuse burnerin the
immediate vicinity of the burning of leaves, brush or tree limbs.
e. That ALL burning take place during the daylight hours.
SECTION 2: That failure to contain any fire is a violation of this
ordinance and if the Fire Department is called upon to extinguish the fire it is
prima facie etidence that said fire was not contained; however, the foregoing
provisions shall not be considered as limiting the introduction of other com•-
pefent bearing upon the question of "Controlled Burning" as set out
in Section 1 hereof.
SECTION 3. Any person violating the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction shall be fined in any sum
not less that Fifty Dollars ($50.00) and not more than One Hundred Dollars ($100.00).
SECTION 4. All conflicting ordinances or parts of an ordinance are hereby
repealed.

Section 5. That in order to control burning in the residential areas
of the City of Van Buren, Arkansas, and necessary in providing for the imme-
diate preservation of the public peace, health and safety an emergency is
declared to exist and the Ordinance shall be, take effect, and be in force
after its passage and publication.
