AN ORDINANCE ENTITLED: AN ORDINANCE DECLARING THE BUSINESS OF TRANSPORTING PERSONS
WITHIN THE CITY OF VAN BUREN, ARKANSAS BY MOTOR AMBULANCE FOR COMPENSATION TO BE A
NECESSARY PUBLIC SERVICE UTILITY SUBJECT TO REGULATION BY SAID CITY: PROVIDING FOR
THE REGULATION, LICENSING AND OPERATION OF SAID PUBLIC SERVICE BUSINESS WITHIN SAID
CITY; PROVIDING PENALTIES FOR THE VIOLATION OF SAME: DECLARING AN EMERGENCY, AND
FOR OTHER RELATED PURPOSES.
WHEREAS, due to the development of motor vehicles, the rapid growth of the City
of Van Buren, and other allied factors, said City Council of said City has found and
determined, and hereby finds and determines that the continuous maintenance of ad-
equate ambulance service twenty -four hours a day, including what is known as emergency
service, for use by the public for compensation, is necessary as a public utility ser-
vice for the inhabitants of said City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,
ARKANSAS:
SECTION 1. That under the Home Rule, powers granted to the Cities of the First
Class by Act 266 of 1971, from and after the passage and approval of this Ordinance,
the business of transporting persons within the City of Van Buren by motor ambulance
for compensation be and the same is hereby declared to be a necessary public utility
service subjecteto regulation by said City; and from and after said date any permit,
license, or certificate heretofore granted to any person, firm or corporation to
operate an ambulance service within said City shall be deemed revoked and the owner-
ship and operation thereof shall be unlawful, unless all such persons, firms, or
corporations shall first comply with the provisions of this Ordinance as hereinafter
set forth.
SECTION 2. The City Council of said City may grant permits to persons, firms
or corporations for the privilege, exclusive or otherwise, of using the streets,
alleys, public ways and public grounds of said City for the purpose of operating an
ambulance service business for the inhabitants of and all other persons within said
City, which said permits shall require that said ambulance service, including emergency
ambulance service must be maintained continuously during all hours.
Said permits shall be granted only upon written application therefore filed with
the City Clerk of said City, and shall be granted only when the City Council of said
City, in its discretion, shall determine that the public convenience and necessity
requires the issurance of same and to determine such public convenience and necessity,
the City Council may hold such hearings and in such manner as it shall deem necessary.

Said permits may be granted for such length of time, upon such terms, and at such
rates as said City Council shall determine; provided, that until otherwise fixed by
Ordinance, said permittees shall not charge any person in excess of Twenty Nine Dollars
and Fifty Cents ($29.50) per trip for other than emergency trips within the limits of
said City between the hours of 7:00 A.M. and 7:00 P.M. o'clock and said permittees
e shall not charge any person in excess of Thirty Five Dollars ($35.00) per trip within
the limits of said City between the hours of 7:00 P.M. and 7:oo A.M. o'clock; and no
person at any time shall be charged more than Thirty Five Dollars ($35.00) for an
emergency trip within said City. Provided more than one person is transported in the
same ambulance for medical treatment, the charge for each additional person shall be
at the rate of Ten Dollars ($10.00) each; that the total bill shall be prorated equally
between all persons transported for medical treatment. Provided, however, said per
mittees may charge a reasonable charge for accessories and devices for emergency treat-
ment provided said permittees file a schedule for said charges with the City Clerk of
the City of Van Buren, Arkansas.
SECTION 3. No permit shall be granted to any person, firm or corporation who is
not the actual bonafide owner, or bonafide operator, thereof and who is not fully
responsible for the operation of said business.
Said City Council may revoke any permit granted hereunder when any holder thereof
shall violate or fail to comply with the provisions of this and all other valid Ord-
inances of Laws regulating ambulances, and when any such permit be revoked, any further
operation of said business shall be unlawful and a violation to the Ordinance; provided,
no permit shall be revoked except upon the giving to the person, firm or corporation
whose permit is sought to be revoked, ten (10) days notice of such intention, and such
person, firm or corporation shall have an opportunity to appear before 844d City Council
and show cause why said permit should not be revoked.
SECTION 4. No permit issued under the terms of this ordinance shall be sold, trans-
ferred, assigned, leased or otherwise disposed of without the consent of City Council.
SECTION 5. Before said City Council shall grant and permit hereunder, as a
minimun requirement the owner or operator of said business applying for same shall de-
posit with the City Clerk of said City, and keep in effect at all times, a policy or
policies of liability insurance issued by a responsible insurance company or companies
dully authorized and licenses to transact such business in the State of Arkansas, in-
suring the owner operator and any and all persons driving any vehicles of said per
mittees as follows:
Against liability up to and including Ten Thousand Dollars ($10,000.00) for
personal injuries or death to any one person; up to and including Twenty Thousand
Dollars ($20,000.00) in account of any one accident resulting in personal injuries
or death to more than one person; and Five Thousand Dollars ($5,000.00) for damage to
property on account of any one accident.
And, also, such policies of liablility insurance must provide that they may not
be cancelled without first giving the City Clerk of the City of Van Buren ten (10)
days notice in writing.
SECTION 6. Each person, firm or corporation issued a permit hereunder shall pay
to the City of Van Buren, for the privilege of so engaging in said business an annual
fee, the amount of which shall be computed upon the basis if the number of ambulances
any permittee may be required to operate under the terms of said permit, which the fee
for each ambulance being Twenty -five Dollars ($25.00) per year, which shall be paid at
the time of the issuance of said permit and on the same date during each succeeding
year during the term for which said permit shall have been granted.
SECTION 7. The owners or active operators and all ambulance drivers employed
by any person, firm or corporation issued a permit under the terms of this Ordinance
shall meet the following requirements, to wit:
(a) All ambulance personnel must meet such paramedical
educational standards as may be prescribed from time
to time by the City of Van Buren in the nature of
attending special courses when offered through the
Red Cross.
(b) All ambulances used by any person, firm or corporation
granted a permit hereunder shall be equipped, as a
minimum, with a siren, warning signals and lights such
as are commonly used on emergency vehicles and all said
ambulances shall also be further equipped with such ac-
cessories and devices for emergency treatment as may be
currently approved from time to time by the committee on
Trauma, American College of Surgeons which, at the present
time, are as follows:
1. Large Made Dressings.
2. Sterile gauze pads
3. Three -and six -inch gauze or muslin bandages.
4. Four and six -inch cotton elastic bandages.
5. Adhesive tape (cylinder cut 1 ",2 and 3
6. Tourniquets.
7. Tongue blades, thr -e taped together and
padded for mouth gag.
8. Bandage shears.
9. Safety pins, large size.
10. Triangular bandages or slings.
11. Inflatable splints (lower and upper limb.)
12. Two or more plywood spine boards.
13. Several Pillows.
14. Oxygen tanks and masks of assorted sizes
II/ for administration.
15. Oropharyngeal airways.
16. Mouth to mouth, two -way resucitation airways
adults and children sizes only.
17. Suction.
18. Belting straps for application of spine boards.
Any person, firm, or corporation granted a permit hereunder who shall violate any of
the foregoing provisions, or fail to meet the foregoing minimum standards or who shall
employ any person as ambulance personnel who shall fail to meet the foregoing minimun
standards shall, in addition to other penalties provided by this Article, be subject
to having his permit cancelled within the discretion of the City Council.
SECTION 8. Any person who shall fail to comply with any or all of, or who shall
violate, the provisions of this Ordinance shall be deemed guilty of a misdemeanor,
and upon conviction shall be fined not less than Twenty -five Dollars (525.00), nor
more than Five Hundred Dollars ($500.00).
SECTION 9. The provisions of this Ordinance shall not apply to any person,
firm or corporation engaged in rendering ambulance service whose place of business
and vehicles are located in another municipality and whose ambulances infrequently
come into, through or out of the City of Van Buren.
SECTION 10. It having been found and determined that inadequate emergency am-
bulance service within said City, will result in a condition menacing to the public
peace, health and safety and, therfore, an emergency exists and this Ordinance being
necessary for the immediate preservation of said public peace, health, and safety,
same shall be in full force and effect from and after its passage and approval.
