ORD NO 39-1976 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 3 -1976 AN ORDINANCE AUTHORIZING THE MAYOR TO NEGOTIATE FOR PURCHASING ASPHALT TO REPAVE STREETS IN THE CITY OF VAN BUREN, ARKANSAS. WHEREAS, the City of Van Buren, Arkansas, has an immediate need to re -pave streets in the City of Van Buren, Arkansas, and WHEREAS, there are not enough streets needed to be repaved, and WHEREAS, Section 19 -4426 of the Arkansas Statutes 1947, annotated, provudes that the governing body, by ordinance, may waive the requirements of competitive bidding in exceptional situations where such procedure is deemed feasible or practical. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: 1. That the City Council waives the requirement of competitive bidding in this particular case, as such a procedure is not deemed feasible or practical, and that the Mayor is authorized and directed to negotiate the purchase of asphalt on a per ton basis to repave the streets, as heededm necessary. 2. This Ordinance being immediately necessary to obtain asphalt for re- paving streets and necessary in providing for the immediate pre- servation of the public peace, health and safety, and emergency is declared to exist and this Ordianance shall be, take effect and be in force after its passage and publication.
