ORD NO 38-1976 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 33 -1976 s AN ORDINANCE AUTHORIZING THE MAYOR TO NEGOTIATE FOR A LEASE PURCHASE OF A FIRE TRUCK. WHEREAS, the City of Van Buren, Arkansas, has an immediate need to purchase a Fire truck, and WHEREAS, to take any bids, and the time to complete the transaction, would be disastrous to the City of Van Buren, Arkansas, and /WHEREAS, the cost is in a constant state of rising at the present time, and WHEREAS, Section 19- 44 -26, of the Arkansas Statutes, 1947, annotated, provides that the governing body, by ordinance may waive the requirements of competitive bidding in exceptional situations where such procedure is deemed infeasible or praitable. NOW, THEREFORE, BE IT ORDAINED by the City Council of the Cith of Van Buren, Arkansas, 1. That the City Council waives the requirement of competitive bidding in this particular case of such a procedure, is not deemed feasible or practical, and the Mayor is authorized and directed to enter into a lease purchase agreement for one (1) 1250 G. P. M. Pumper with a 500 gallon booster tank on our Ford C -900 Pumper Chassis, with Amer- -lean La France. 2. This Ordinance being immediately necessary to obtain Fire Fighting Equipment and necessary for the immediate preservation of the public peace, health and safety, and emergency is declared to exist and this Ordinance shall be, take effect and be in force after it's passage and publication.
