ORD NO 20-1976 ORDINANCE NO. 2 O -1976 AN ORDINANCE AMENDING ORDINANCE NO. 11 -1962 FIXING RATES AND CHARGES FOR SEWER SERVICES AND SEWER TAP CHARGES IN THE CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER PURPOSES. WHEREAS, the cost of labor and material for sewer tapping charges within the City of Van Buren, Arkansas, have increased materially since the same were fixed by Ordinance No. 11- 1962 passed and approved November 12, 1962; and, WHEREAS, the City of Van Buren, Arkansas, is obligated to maintain its sewer system, keep the same in repair and pay the existing bonded indebtedness thereon, together -with the cost of operation thereof, and that the raise in cost be passed on to its customers; and, WHEREAS, it is necessary for the City Council of the City of Van Buren, Arkansas, to establish charges for tapping sewers within the City to insure that the same remain uniform and equitable; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: Section One. That tapping fees mentioned and described in Section One of Ordinance No. 11 -1962 be revised and estab- lished as follows: Tapping fee tapped on back lot line easement, $45.00 Tapped on street (regardless of surface), $75.00 Section Two. The City Council hereby finds that said tapping charges are reasonable and necessary, they result in a raise of $25.00 from the existing charge, and it is neces- sary that same be charged and collected in order to produce Ali sufficient revenue to pay outstanding bonds and interest as they mature, the cost of making the taps and other costs of maintaining and operating the sewer system. Section Three. All ordinances and parts of ordinance s• in conflict herewith are hereby repealed. 1 2 Section Four. It is ascertained and declared that there is immediate need in order to protect the health, lives and property of the inhabitants of the City of Van Buren, Arkan- sas, to charge and collect the fees and charges hereinabove set out; therefore, an emergency is found to exist, that this ordinance is necessary for the preservation of the public peace, health and safety, same shall take effect and be in force without delay, and same shall be charged for all taps made to said system and shall be paid in advance of such service on or after July 1 1976.
