ORD NO 12-1976 ORDINANCE NO. 1976
AN ORDINANCE PROVIDING FOR A CASH OR A PERFORMANCE BOND WITH THE
CITY IN THE AMOUNT OF TWO HUNDRED DOLLARS ($200.00) FROM THE PERSON
FIRM, OR CORPORATION RAZING A BUILDING IN THE CITY OF VAN BUREN,
ARKANSAS, TO INSURE THAT THE LOT IS CLEANED -UP AFTER THE BUILDING
IS TORN DOWN.
o r WHEREAS, The City of Van Buren, Arkansas and owners of
buildings have been plagued by razing people who do not clean -up
the lot after the building is demolished,and
WHEREAS, The Cost of finishing clean -up work left by the
Person, Firm, or Corporation razing a building is causing an
additional cost and responsibility to the owners of said building
and the City of Van Buren.
NOW THEREFORE BE IT ORDAINED by the City Council of the
City of Van Buren, Arkansas.
SECTION I. That before a permit shall be issued by the
Building Inspector to raze a building, the Person, Firm, or
Corporation shall file with said Building Inspector a bond in
the penal sum of Two Hundred Dollars ($200.00) conditioned that
upon completion of said razing of said building that said lot will
be cleaned -up and debris disposed of in a lawful manner.
SECTION II. That said Person, Firm or Corporation razing
said building shall have ninety (90) days from said permit issuance
to raze said building and the clean -up of the lot. That for good
cause the inspector may grant an extension of time not to exceed
thirty (30) days.
SECTION III. That if the lot or lots is cleaned -up to
where it is not unsightly, unsanitary, or unsafe, the bond will be
returned; otherwise the bond shall be forfeited and used to clean-
up and haul off said debris.
SECTION IV. That Ordinance No. 12 -1970 is repealed as it
is obsolete.
SECTION V. In order to protect our citizens from unsafe,
unsightly and unsanitary messes as the result of razing a building,
this Ordinance, being necessary for the preservation of the public
peace, health, comfort, convenience, morals, safety and welfare of
the City of Van Buren, an emergency is declared to exist and this
Ordinance shall be in full force from the date of its approval.
