03 March 2013 Special MINUTES OF THE VAN BUREN, ARKANSAS SPECIAL CITY COUNCIL MEETING HELD MARCH 5, 2013 A special called meeting of the City Council of the City of Van Buren, Arkansas met at 5:00 p.m., on Tuesday, March 5, 2013 at City Hall. The meeting was called to order by Mayor Freeman. Council members present were Alderman Parker, Blake, Moore, Ragsdale, and Dodd. City Clerk- Treasurer Barbie Curtis and City Attorney Candice Settle were also present. Alderman Sagely was absent. This made a total of eight (8) present. A quorum was declared. The Mayor ordered spread upon the minutes, the "NOTICE OF SPECIAL MEETING AND WAIVER OF REGULAR NOTICE OF AND CONSENT TO SPECIAL MEETING." On the agenda next was to consider A RESOLUTION TO AMEND THE MINUTES FROM THE JANUARY 28, 2013 REGULAR CITY COUNCIL MEETING. The City Clerk read the Resolution in its entirety. Mayor Freeman asked if there was any discussion. Mayor Freeman explained that the emergency clause was adopted and unanimously passed by the council but was not reflected in the minutes. Alderman Dodd seconded by Alderman Parker moved that the Resolution be adopted. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Parker, Blake, Moore, Ragsdale, and Dodd. Nays none. The Mayor thereupon declared the Resolution adopted and signed the Resolution, which was attested by the City Clerk and impressed with the seal of the City. THE RESOLUTION WAS GIVEN THE NUMBER 2 -10 -2013 CITY OF VAN BUREN, ARKANSAS RESOLUTION NO. 6t 10 2 013 BE IT ENACTED BY THE CITY COUiNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, A RESOLUTION TO BE ENTITLED: A RESOLUTION TO AMEND THE MINUTES FROM THE JANUARY 28 2013 REGULAR CITY COUNCIL MEETING. WHEREAS, the City of Van Buren, Arkansas desires to amend its minutes from the monthly regular City Council meeting of January 28, 2013 to include a portion of the Meeting that was not reflected in the minutes that were previously approved. NOW, TIICREFORE, BE IT RESOLVED 13Y THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION 1: The last paragtaph reflecting adoption of Ordinance No. 1 -2013 is amended to read as follows "The Mayor then declared, the Ordinance passed. The Mayor thereupon asked for a motion to adopt the emergency clause. Upon motion duly made and seconded, all aldermen voted for adoption of the emergency clause. The Mayor then declared that the emergency clause *as unanimously adopted. I-Ie then sighed the Ordinance in open Council, duly attested by the City Clerk" IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by City Council, did' pass; approve, and adopt, by a vote of ,J for and against, the foregoing Resolution at its regular meeting held on the 5 of March 2013. Settle City Clerk/Treasider City Attorney Mayor Freeman provided the council with a copy of the letter from Allen Canning Company. The closing will not only impact 125 families, but will also affect Van Buren Municipal Utilities and the City of Van Buren as Allen Canning uses as much water as all the Van Buren residents combined. Mayor also informed the council that starting tomorrow Rena Road will be going one -way. There is no estimation of how long it will remain one -way. There being no further business, motion was made by Alderman Parker seconded by Alderman Moore to adjourn. The Council followed with a unanimous vote.
