RES NO 10-02-1979 CITY OF VAN BUREN, ARKANSAS RESOLUTION NO.1 -1979 0 WHEREAS, the City Council in Resolution 1 -5 -79 authorized the City Attorney to submit written comments to the Arkansas Public Service Commission Hearing "IN THE MATTER OF THE ELIMINATION OF MUNICIPAL TAXES EHOM BASE RATES OF UTILITIES AND THE ADOPTION OF UNIFORM TAX ADJUSTMENT CLAUSE." WHEREAS, the City of Van Buren, Arkansas and the -City of Fort Smith, Arkansas have filed comments in the above proceedings, and WHEREAS, we have respectftlly requested that the Public Service Commission determine a uniform amount of franchise taxes to be absorbed by the Company for rate making purposes based upon current conditions of 4% of gross revenue, and WHEREAS, the City of Mulberry, Arkansas, has passed an Ordinance levying a 3% charge against Allied Telephone Company of Arkansas, Inc., and WHEREAS, the Allied Telephone Company of Arkansas has filed a complaint against Mulberry before the Arkansas Public Service Commission attaclQing same on the ground that it is a sales tax forbidden by law and unreasonable, and WHEREAS, the decision will adversely affect all cities in the State of Arkansas, including Van Buren, Arkansas. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, That the City Attorney is authorized and directed to take such action as he deems in the best interest of the City of Van Buren, Arkansas in Allied Telephone Company of Arkansas vs City of Mulberry, Arkansas in Docket U -3054.
