ORDINANCE NO. 3 0 -1979
AN ORDINANCE MAKING IT A MISDEMEANOR TO KEEP, OR WILLFULLY RESIDE IN, OR TO
RESORT TO A HOUSE OF ILL FAME, A BAWDY HOUSE, A DISORDERLY HOUSE OR ANY HOUSE
FOR THE PURPOSE OF ASSIGNATION OR LEWDNESS, COMMON REPUTE AS EVIDENCE, PENALTY
FOR VIOLATION, MAKING THE OPERATION OF THE ABOVE A PUBLIC NUISANCE. PUNISHMENT
FOR VIOLATION, SECTION ARE SEVERABLE, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS.
SECTION I. Hereafter every person that keeps a house of ill fame, a bawdy
house, a disorderly house or any house used for the purpose of assignation or
lewdness or any person who willfully resides in, or resorts to such house is
guilty of a misdemeanor and upon conviction shall be fined in any sun not ex-
ceeding five hundred dollars (500.00) or imprisoned in the County jail not to
exceed six (6) months or by both said fine and imprisonment.
SECTION II. In all prosecutions or proceedings for keeping, residing in or
resorting to such houses of ill repute, bawdy houses, disorderly house or any
house used for the purpose of assignation or lewdness, common report may be
received as coupetient evidence of the character of the house, the purpose for
which it is being used or kept and the character of the persons inhabiting or
resorting to it.
SECTION III. The provisions of this Ordinance are severable and if any of
the provisions hereof .shall be held void or invalid, the remaining parts or pro-
visions shall not be affected or impaired.
SECTION IV. The need to allow the City of Van Buren, Arkansas, to execute
the power given it by Section 19 -2304, Paragraph Four of the Revised Statutes of
Arkansas, 1947, to proceed against ,common law nuisance by prosecution in the Mun-
icipal Court has become apparent. An emergency is therefore declared and this
Ordinance being necessary for the preservation of the public peace, health, and
safety shall be in full force and effect from and after its passage.
