ORD NO 22-1979 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO 1979 AN ORDINANCE DEFINING THE TERM "CONTROLLED INTERSECTION" DECLARING IT UNLAWFUL TO CORNER CUT, SETTING PENALTY, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF VAN BUREN, ARKANSAS, THAT: SECTION 1. Definition: For the purpose of this Ordinance the term "Controlled Intersection" shall refer to any section of two (2) or more streets at which the flow of vehicular traffic is regulated by any type of traffic signs or device. SECTION 2. It shall be unlawful for any person to drive any motor vehicle from a public street, highway or alley onto any privately owned place of business and then to drive such vehicle back onto any public street, highway or alley for the purpose of avoiding the necessity of driving such vehicle through the controlled intersection. For the purposes of this section, any person who shall drive his vehicle as prescribed in the preceding sentence shall be presumed to have done so for the purpose of avoiding such controlled intersection. SECTION 3. Any person violating the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined in a sum of not less than $25.00 and not more than S100.00. SECTION 4. The practice of cutting corners in the City of Van Buren, Arkansas, has become a problem and has resulted in a serious traffic hazard which is dangerous to motor vehicle operators. An emergency is therefore declared and this Ordinance being necessary for the preservation of the public peace, health, and safety shall be in full force from and after its passage.
