ORDINANCE NO. 4 -1980
AN ORDINANCE TO PAY THE REASONABLE AND NECESSARY LEGAL EXPENSES OF MASON CHILDERS
IN THE CASE OF KENNIS RICHARDS, INDIVIDUALLY, ETC. VS. OFFICER MASON CHILDERS,ET AL,
AND TO WAIVE COMPETITIVE BIDDING.
WHEREAS, Mason Childers and the City of Van Buren, Arkansas has been sued
by Kennis Richards for alledged civil rights violations, and
WHEREAS, Mason Childers was a police officer on or about the 28th day of
December, 1978, and
WHEREAS, it is to the best interest of the City of Van Buren to provide
legal services to officers who are sued for alledged civil rights violations,
and
WHEREAS, Section 19 -4425 of the Arkansas statutes anotated, provides
that the governing body, by ordinance, may waive the requirements of competi-
tive bidding in exceptional situations where such procedure is not deemed
feasible or practical.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,
ARKANSAS:
1. That the City Council waives the requirement of competitive bidding
in this particular case as such procedure is not deemed feasible or practical.
2. That the Mayor is authorized and directed to pay the reasonable and
necessary legal expenses of Mason Childers.
3. That this Ordinance being necessary for the immediate preservation
of the public peace, health and safety, an emergency is declared and this
Ordinance shall be and take effect and be in full force after it's passage,
approval and publication.
