ORD NO 34-1980 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 34 -1980 WHEREAS, a Petition was duly filed with the City Council of the City of Van Buren, Arkansas, on the 20th day of October, 1980, asking the City Council to vacate and abandon all that part of the alley behind Lots 4,5,& 6 of Block 20, Riverside Addition that has not been taken as right of way for South 4th Street, and WHEREAS, the Council did on the 20th day of October, 1980, pass its Resolution setting the date of the hearing on the Petition and ordering the City Clerk to give notice of such hearing as required by law, and WHEREAS, after due notice as required by law, the Council has at the time and place mentioned in the notice heard all persons desiring: to be heard on the question and has ascertained that that portion of the alley hereinabove designated has heretofore been dedicated to the public use as an alley and that the same has not been actually used by the public generally for a period of more than five years preceeding this date; That all the owners of the property abutting upon such alley to be vacated have filed with the Council their written Petition to such abandonment and the public interest and welfare are not adversely affected by the abandonment of such alley. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1. The City of Van Buren, Arkansas, hereby releases, vacates, and abandons all its rights, together with the rights of the public gen- erally, in and to that portion of the alley behind Lots 4,5, 6 of Block 20, Riverside Addition that has not been taken as right of way for South 4th Street. SECTION 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the deed records of Crawford County, Arkansas.
