ORDINANCE NO. 1980
AN ORDINANCE AMENDING ORDINANCE NO. 8 -1963, THE SAME BEING
THE SUB- DIVISION REGULATIONS.
1. THAT Section I.0 is amended to read as follows:
C. The territorial jurisdiction of these regulations
includes the land within the corporate limits of the
City of Van Buren.
2. THAT Section II. A -1 is amended to read as follows:
1. Submission
After discussing a sketch plan of the proposed sub-
division and the requirements of the regulations gen-
erally with the Sub- Committee of The Planning Commission,
the subdivider shall submit to the Sub Committee of The
Planning Commisssion, a preliminary plat, together with
pertinent supporting data, in ten (10) copies, at least
seven (7) days prior to the meeting of the Sub Committee
of The Planning Commission at which consideration is
requested. The Preliminary Plat shall show and include
the following information on sheets 24 inches by 36 inches.
3. THAT Section II A -1 -a is amended to read as follows:
a. General
(1) Name of Subdivision
(2) Boundary of Sub Division
(3) Names and addresses of the owner, developer and the
registered engineer preparing the plat, and the
registered engineer's seal.
(4) Scale of plat, one (1) inch equals one hundred (100)
feet, on sheets 24 inches by 36 inches.
(5) Date, north arrow, and scale.
(6) Vicinity map, at a legible scale, on Preliminary
Plat, showing the location of all abutting streets
and development and such further information on
surrounding territory as may be requested by the
Sub Committee of The Planning Commission.
4. THAT Section II A 1 -b -4 is amended to read as follows:
(4) Topography with contour lines at two (2) feet intervals.
(5) THAT Section II A 1 -b is further amended to add a new subscription
(5) Lot addresses shall be noted.
6. THAT Section II B 1,2, and 3 is amended to read as follows:
Final Plat
1. Submission
After approval of the Preliminary Plat, and the installa-
tion or the provisions made for installation of required
improvements as specified in Chapter V, Improvements,
the Subdivider shall submit to the Planning Commission
a Final Plat for recording purposes, together with cer-
tificates and other supporting information. Such sub-
mission shall be made at least seven (7) days prior to
the Sub Committee of The Planning Commission meeting
at which consideration is requested.
2. Copies of Final Plat
One (1) original drawing on white clothback 100% new
rag water resistant, white drawing paper in India ink,
and five (5) genuine blue print copies at scale of one
(1) inch equals one hundred (100) feet, on sheets 24
inches by 36 inches.
3. Information in Final Plat
The Final Plat shall show and contain the following
information:
a. Name of Sub Division
b. Boundaries of Sub Division: it's legal description
and zoning district in writing in upper right hand
corner.
c. Names and addresses of owner, developer, and regist-
ered surveyor or registered engineer, and the seal of
the registered surveyor or engineer.
d. Acreage in subdivision tracts.
e. Date, north arrow, and scale.
f. Location and description of all monuments.
g. Location of and names of all streets, highways,
alleys, parks, or public purpose areas, if any, and
easements with dimensions and proper engineering
description within the proposed sub division.
h. Location of all streets, and utility easements and
areas for public uses, if any, to be dedicated.
i. All set -back lines with dimensions.
j. Dimensions and number of all lots and the number,
or letter, of all blocks within the proposed sub-
division.
k. Bearing in degrees and minutes of all lots, block or
street lines which are not at 90 angle
1. Notice on Plat covenants.
m. Street Curvature characteristics.
7. THAT Section II B 4 -b 4 -e is amended to read as follows:
4 -b. Certificate of Accuracy by Registered Surveyor or
Registered Engineer.
4 -e. Certificate of Approval of all Building set -back
dimensions by City Building Inspector.
8. THAT Section II B 4 is further amended to provide for a new
section II B 4 -h.
4 -h. Lot addresses shall be noted.
9. THAT Section IV A is amended by adding the following:
And approved by the Water and Sewer Department.
10. THAT Section IV B 2 is amended to read as follows:
When the subdivision cannot be served by existing sanitary
sewers, septic tank disposal or other approved disposal methods
shall be provided in accordance with plans and specifications
approved by the Water and Sewer Department Engineer and Arkansas
State Board of Health.
11. THAT Section IV c is amended to read as follows:
Storm Drainage shall be constructed in accordance with the
minimum design standards as established by the City Council.
12. THAT Section IV e will be amended to delete the following:
Or its agents.
13. THAT Section IV g 1 shall be amended as follows:
Deposits Cash, A Performance Bond, or Irrevocable Letter of Credit
Such deposits of cash, a performance and payment bond or irrev-
ocable letter of credit with the City shall be in an amount equal
to the estimated cost of improvements as determined by the City
Engineer or other City Officials for the entire subdivision or
portion thereof. Upon satisfactory completion -of the improvements,
and the passage of the warranty period,the subdivision may withdraw
any deposit made.
14. THAT Section IV G 2 -b is amended.as follows:
The contract shall specify the date that all improvements shall be
installed, not to exceed one (1) year from date of the contract.
That Section IV G is further amended to add a new paragraph IV G
2 -c. Building permits not issued until improvements are in and
approved.
15. THAT Section V A is amended as follows:
Variances
Whenever the tract to be subdivided is of such unusual size,
shape or topography, or surrounded by such development or conditions
that the provisions of these regulations shall result in sub-
stantial hardship on the subdivider when such hardship is unique
or peculiar to the tract of land, the Planning Commission may vary
or modify such requirements to the end that the subdivision may be
developed consistent with public welfare and safety and will not
result in undermining the intent of these regulations.
