ORDINANCE NO. S 1980
AN ORDINANCE ENTITLED: AN ORDINANCE TO AMEND ORDINANCE NO. 7 -1963 FOR THE PURPOSE
OF ADDING A "HISTORIC DISTRICT ZONE" AND FOR OTHER PURPOSES.
WHEREAS, The Planning Commission of the City of Van Buren, Arkansas, held
a public hearing in this matter on March 4, 1980, and
WHEREAS, The Planning Commission recommends the adoption of the "Historic
District Zone
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,
ARKANSAS:
THAT Ordinance No. 7 -1963 be amended as follows:
1. Amendment to Article II "Definitions" to add Historic Zoning District. The zoning
district within the Central Commercial District, C 1, that has the identical
boundaries of the Van Buren Historic District.
2. Amendment to Article III, "Establishment of Districts," Section I, Classification
of Districts, for the purpose of this Ordinance, Van Buren, Arkansas, has 11 zoning
districts designated as follows:
Government and Public Use Zone
R -1 Single Family Residential District
R-2 Two Family Residential District
R -3 Multi Family Residential District
R -4 Mobile Home District
C -1 Central Commercial District
C -2 Thoroughfare Commercial District
H UL tunic Di4t ict Zone
I -1 Light Industrial. District
1 -2 Heavy Industrial District
0 -1- Open Area Zone
3. Amendment to Article III, "Establishment of Districts," Section 2, Boundaries of
Districts, add #7. The Historic District zone's boundaries shall be identical
to the existing boundaries of the Historic District's boundaries as identified by
Ordinance -1977 A map detailing these boundaries shall become a permanent
part of this amendment and shall be added to the Official Zoning Map of Van Buren,
Arkansas.
Authority
The authority to establish a Historic District Zone is granted under Arkansas Acts
1957 186 as amended. This authority is further cited in Arkansas Statutes annota-
ted Title 19, Chapter 28 Sections:
19 -2802, Power of cities of first class to regulate construction
of buildings permits
19 -2805, Establishment of zones
19 -2829, Implementation of plans
JURISDICTION
Regulations regarding the Historic District Zone shall apply only to the area that has
been identified as the Van Buren Historic District, with identical boundaries as the
District. A copy of this boundaries shall be a part of the Amendment, and shall be-
came a part of the Official Zoning Map for Van Buren, Arkansas.
Any properties outside of the Historic District yet still within the Central Com-
mercial District, C -1, shall continue to conform to the regulations/ of C -1, Central
Commercial Business District zone.

Declaration of Policy
It is the stated policy of the City of Van Buren, Arkansas, that the rehabilitation
preservation, and restoration of the structures within the Van Buren Historic
District is in the best interest of the general welfare of the public. Additionally,
the use, re -use, or altered use of the structures within the Historic District is a
beneficial and an integral part Of the redevelopment of the City. Further, any use,
re -use, or altered use of any structure within the Historic District must not violate
any of the City codes or ordinances that apply and are appropriate for the proposed
use of the structure.
Permitted Uses
All uses currently allowable under the C -1 Central Counercial District,
and two family residences and, under certain conditions, single family
residences.
Single family residences will be allowed when they are in connection with
the retail or commercial establishment, and only when the residence is
the dwelling of the proprietor of the retail or commercial establishment.
These dwellings must conform to the set back requirements contained in the
:Historic District Zone regulations.
Minimum Square Footage for Residential Uses
The minimum square footage for the single family proprietor residence shall
be 650 square feet.
The minimum square footage for the two family residences shall be 600
square feet per unit.
Front Set Back
The front building set back line shall be the same as existing feet from
the center line of the street. The type of facade, its structual integrity
and other physical characteristics of the facade will be determined by the
Van Buren Historic District Commission's regulations.
When a single family proprietor's residence is located on the street level
floor of a retail or commercial establishment, there must be a minimum of
24 feet set back from the store front, so as to maintain the character
of the structure as viewed from the street. This does not apply to other
floors used as residences within the structure nor does it apply to existing
residential structures within the District.
Rear Yard
Minimum: 20 feet property line or center line of alley where one exists.
Height
Maximum height of any structure in the Historic District Zone shall be 3 stories and
not greater than 48 feet.
Loading and Unloading
Loading and unloading facilities shall be provided so as not to block any public way.
Parking
For retail and commercial establishments, adequate parking exists in the
municipal parking lots and with the on- street parking. Provisions shall
be made for on -lot and customer parking to handle normal anticipated demand.
For residential uses, the parking requirements are as follows:
single family proprietor residences 1 space /unit
two- family residences 1.5 spaces /unit
Indications of adequate parking must be demonstrated in the same block as
the proposed use either /or within 300 feet of unit.
Restrictions on Construction
No rehabilitation, restoration, or improvement work shall be done to any structure
in the Historic District Zone until the City Building Inspector indicates in writing
to the City and the person or persons having the work done that the improvements
are in conformance with City codes and appropriate regulations that apply to the
proposed use.
