ORD NO 11-2009 CITY OF VAN BUREN. ARKANSAS ORDINANCE NO. I1 -2009 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE AMENDING ORDINANCE 31 -1999 TO IMPOSE AN ADDITIONAL 520.00 JAIL FEE ON ALL MISDEMEANOR AND TRAFFIC VIOLATIONS IN THE CITY OF VAN BUREN; TO PROVIDE FOR SEVERABILITY; TO PROVIDE FOR AN ADOPTION DATE AND EFFECTIVE DATE; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, The General Assembly of the State of Arkansas enacted Act 209 of 2009, which is effective July 1, 2009, to provide for increases of fines for misdemeanor offense and violations, in order to defray the cost of incarcerating prisoners; and WHEREAS, The City of Van Buren previously adopted Ordinance 31 -1999 imposing an additional $5.00 fee to defray jail costs for the city; and WHEREAS, the City of Van Buren has found that the purposes herein require immediate attention, for the protection ofthe health, welfare and safety of the inhabitants of the City of Van Buren, and as herein set out. an emergency exists and is hereby declared to exist. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION 1: Pursuant to the authority granted by A.C.A. 16 -17 -129, as amended by Act 209 of 2009, Van Buren Ordinance 31 -1999 is hereby amended to provide for an additional $20.00 jail fee to be levied and collected where the Defendant pleads guilty or nolo contendere to, is found guilty of, or otherwise forfeits bond for any misdemeanor or traffic violation in the Van Buren District Court. SECTION 2: This additional jail fee shall be used exclusively to defray the cost of incarcerating city prisoners, including the construction and maintenance ofa city jail and payments to other entities for incarcerating city prisoners. SECTION 3: The various provisions and parts of this Ordinance are hereby declared to be severable, and, if any section or part of a section, or any provision or part of a provision herein, is declared to be unconstitutional, inappropriate, or invalid by any court of competent jurisdiction, such holding shall not invalidate or affect the 0 remainder of this Ordinance and to that extent the provisions hereto are declared to be severable. SECTION 4: All ordinances, resolutions or other acts of the City in conflict with the terms hereof are repealed or amended to the extent of any such conflict, consistent herewith. SECTION 5: The adoption date of this ordinance is June 15, 2009. SECTION 6: The effective date of this ordinance is July 1, 2009. SECTION 7: It is hereby found and declared by the City of Van Buren, Arkansas. that in order to comply with Act 209 of 2009, it is necessary that this ordinance become effective immediately, and therefore, an emergency is hereby declared to exist, and this ordinance, being necessary for the immediate preservation of the public peace, health and safety, shall be in full force and effect upon the date setforth herein.
