ORD NO 22-2012 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 2012 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND TO AUTHORIZE THE REIMBURSMENT OF CRAWFORD COUNTY FOR BRIDGE REPLACEMENT COSTS ON EAST POINTER TRAIL. WHEREAS, the East Pointer Trail bridge lies on the border of the City of Van Buren and unincorporated Crawford County as a result of which the two entities have historically split the cost of repairs and maintenance to said bridge; and WHEREAS, said bridge is in need of replacement for the health, safety, and welfare of the citizens of the community; and WHEREAS, replacement of said bridge has been competitively bid by the Crawford County Judge with the low bid of $212,342.00 from Crawford Construction Company worksheet attached hereto Exhibit "A and WHEREAS, the City Council has determined, pursuant to ARK. CODE ANN. 14-58 303(b)(2)(B) that exceptional circumstances exist, which render the competitive bidding process on the part of the City of Van Buren to not be practical; and WHEREAS, the Arkansas Department of Emergency Management has committed $75,000.00 to said project; and WHEREAS, replacement of said bridge will be made, for which the City of Van Buren will commit funds not to exceed $75,000.00 to Crawford County for its share of replacement costs. NOW, THEREFORE, BE IT ORDINANED AND ENACTED BY THE CITY COUNCIL OF VAN BUREN, ARKANSAS, THAT: SECTION 1. The City of Van Buren commits up to 575,000.00 to Crawford County for its share of costs for the replacement of the East Pointer Trail bridge project within its corporate city limits. SECTION 2. The Mayor and City Clerk are hereby authorized by the City Council for the City of Van Buren to reimburse Crawford County, from capital improvement funds, up to $75,000.00 for its share of improvements made to the East Pointer Trail bridge project. SECTION 3. The City Council in accordance with the terms of ARK. CODE ANN. 14-58 303(b)(2)(B), hereby waives the requirement of competitive bidding and authorizes and directs the Mayor to enter into a contract within the guidelines set forth in Section 2 above.
