ORD NO 14-1981 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 14 -1981 AN ORDINANCE ENTITLED: AN ORDINANCE TO AMEND ORDINANCE NO. 7 -1963, FOR THE PURPOSE OF REZONING CERTAIN PROPERTY IN THE CITY OF VAN BUREN, AND AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN, ARKANSAS. WHEREAS, Howard Alexander, Lillian Alexander, Hill Alexander, and Velma Alexander, have filed a petition to rezone property herein below described from R -1 to R -3 and C -2; and WHEREAS, A Notice of Public Hearing before the Van Buren Planning Commission was published; and WHEREAS, A Public Hearing was held by the Van Buren Planning Comm- ission; and WHEREAS, There were persons opposed to said rezoning at said Public Hearing; and WHEREAS, The Planning Commission has recommended the zone change subject to a restrictive covenant to the effect that a solid 10 foot high fence be built on the West boundary of the C -2 area as a requirement. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: Section 1. That the following described property, to wit: Beginning at the Northeast Corner of the Northwest Quarter Southwest Quarter of Section 13, Township 9 North, Range 32 West, Thence North 87 degrees, 35' 15" West 400 feet, thence South 01 degrees 30' West 600 feet; thence South 87 degrees, 35' 15" East 400 feet; thence North 1 degree 35' East 600 feet to the point of beginning. The North 300 feet,of the above described property should be and is hereby rezoned from R -1 to C -2 and the South 300 feet of the above described property should be and is hereby sent back to the Planning Commission for a. rehearing. Section 2. That this Ordinance shall take effect after the petitioners have filed a binding restrictive covenant to the effect that a solid 8 foot high fence be built on the West Boundary of the C -2 area as a requirement upon development of the property. Section 3. That this Ordinance being necessary for the im- mediate preservation of the public peace, health and safety, an emergency is declared and this Ordinance shall be and take full force after its passage, approval, publication, and the filing of the restrictive covenant required in Paragraph 2 hereof. 0 PASSED AND APPROVE THIS 18th DAY OF May 19 81 M 1 ATTESTED: CI Y CLERK -TRE SURER
