ORD NO 06-1981 CITY OF VAN BUREN, ARKANSAS
ORDINANCE NO. 6 1981
AN ORDINANCE TO AUTHORIZE THE MAYOR TO NEGOTIATE FOR THE PURCHASE
OF A SIX STAGE VERTICAL PUMP AND SPARE PARTS FOR MOTOR, WITH THE
CITY TO PAY ONE -HALF OUT OF PRIOR YEARS BALANCES, AND ONE -HALF OUT
OF THE FUNDS FURNISHED BY THE VAN BUREN WATER SEWER DEPARTMENT
AND WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING, AND DECLARING
AN EMERGENCY.
WHEREAS, The City of Van Buren is facing the possibility of a
water shortage, and
WHEREAS, It currently has one pump and motor to pump water from
the treatment plant reservoir, and
WHEREAS, If major trouble developed in the pump or motor it could
take fourteen (14) to sixteen (16) weeks to get it back
into service, and
WHEREAS, Both the City of Van Buren, and the Van Buren Water and
Sewer Department has limited funds, and
WHEREAS, Section 19 -4425 of the Arkansas Statutes, annotated,
provides that the governing body, by ordinance, may waive
the requirements of competitive bidding in exceptional
situations where such procedures are not deemed feasible
or practical.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN, ARKANSAS:
1. THAT the City Council waives the requirements of
competative bidding in this particular case as such
procedure is not deemed feasible or practical.
2. THAT the Mayor is authorized and directed to negotiate
the purchase of a six stage vertical pump and spare
parts for the motor.
3. THAT the City will pay for said purchase: one -half
from prior year's balances, and one half from funds
furnished by the Van Buren Water Sewer Department.
4. THAT this ordinance being necessary for the immediate
preservation of the public peace, health and safety,
an emergency is declared and this ordinance shall be
and take effect and be in full force after its passage,
approval and publication.
