ORDINANCE NO. -1982
AN ORDINANCE AUTHORIZING THE MAYOR TO CONTRACT WITH ECKO, INC. OF
0FAYETTEVILLE, ARKANSAS, TO RESURFACE THE TENNIS COURTS ON POINTER TRAIL.
WHEREAS, The playing area of the six tennis courts on Pointer Trail
are in need of resurfacing; and
WHEREAS, ECKO, Inc., has offered to do the necessary work at a price
of $4,750.00; and
WHEREAS, Section 19 -4425 of the Arkansas Statutes, annotated, provides
that the governing body, by Ordinance, may waive the require-
ments of competitive bidding in exceptional situations where
such procedure is not deemed feasible or practical.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,
ARKANSAS:
1. THAT the City Council waives the requirement of com-
petitive bidding in this particular case as such procedure
is not deemed feasible or practical.
2. THAT the Mayor is authorized and directed to contract
with ECKO, Inc. to do the above work and pay for same
out of Revenue Sharing Funds.
3. THAT this Ordinance being necessary for the immediate
preservation of the public peace, health and safety, an
emergency is declared and this Ordinance shall be and
take effect and be in full force after it's passage,
approval, and publication.
