ORD NO 25-1984 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 25 -1984 O AN ORDINANCE AMENDING VAN BUREN INDUSTRIAL WASTE PRETREATMENT ORDINANCE NO. 19 -1981, SECTION 4.03, AND FOR OTHER PURPOSES. WHEREAS, the City of Van Buren, Arkansas, adopted a Waste Pretreatment Ordinance in 1981 identified as Ordinance No. 19 -1981; and WHEREAS, the purpose of the Ordinance was to control and regulate the discharge of wastewaters into the wastewater treatment center of the City of Van Buren, Arkansas, and that the reason for establishing said rules and regulations have not changed; and WHEREAS, Section 4.03 deals with sewer surcharges and that since the initial adoption of Ordinance No. 19 -1981, the amount of surcharges have become inadequate in helping regulate and curb excess wastewater into the treatment system and that it is now necessary to amend said surcharges. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: THAT, Ordinance No. 19 -1981 which has been codified as Section 10.08.04 (3.) be amended as follows: 3. Surcharges. Due to the extra costs of treatment, a surcharge shall be accessed to all non- residential users determined to be discharging BOD and suspended solids as defined by Appendix B of this Ordinance. This surcharge shall be $0.10 per thousand gallons for each parameter measured in excess of 250 mg /1 but less than 425 mg /1. Dischargers which are discharging wastewater having BOD and /or suspended solids concentrations in excess of 425 mg /1 shall be considered in non compliance, however, without implying approval for such non compliance surcharges shall be accessed for discharging in excess of 425 mg /1 at the following rates: (a) For discharge on each parameter measured in excess of 425 mg /1 but not greater than 500, the rate shall be $0.20 per thousand gallons for each unit or fraction of 200 mg /1 in excess of 250 mg /1. (b) For discharge of each parameter measured in excess of 500 mg /1 but not greater than 600, the rate shall be $0.30 per thousand gallons for each unit or fraction of 200 mg /1 in excess of 250 mg /1. (c) For discharge on each parameter measured in excess of 600 mg /1, the rate shall be $0.40 per thousand gallons for each unit or fraction of 200 mg /1 in excess of 250 mg /1. THAT, any and all parts of Ordinance No. 19 -1981 not heretofore specifically amended or changed shall remain in full force and effect from its origination date.
