ORD NO 12-1984 5 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. -1984 AN ORDINANCE AUTHORIZING THE MAYOR TO NEGOTIATE FOR THE INSTALLATION OF A PEDESTRIAN TRAFFIC SIGNAL AT 15TH AND EAST MAIN. WHEREAS, The City has an immediate need to install a pedestrian traffic signal at 15th and East Main; and WHEREAS, There are available funds for such purchase in the 1984 Budget; and WHEREAS, Section 19 4425 of the Arkansas Statutes, Annotated, provides that "The governing body, by Ordinance, may waive the requirements of competetive bidding in ex- ceptional situations where such procedure is deemed not feasible or practical." NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1. THAT the City Council waives the require- ment of competetive bidding in this particular case as such a procedure is not deemed feasible or practical. SECTION 2. THAT the Mayor is authorized to negotiate for the installation of a pedestrian traffic signal at 15th and East Main. SECTION 3. THAT this Ordinance being necessary for the preservation of the public peace, health, and safety, an emergency is declared and this Ordinance shall be and take effect and be in full force after its passage, approval, and publication.
