ORD NO 27-2007 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 49 -2007 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED. AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 (VAN BUREN MUNICIPAL CODE NO. 14.04.01) FOR THE PURPOSE OF REZONING CERTAIN PROPERTY IN THE CITY OF VAN BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER PURPOSES. WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the laws of the State of Arkansas, with all powers, authority and duties of a city of the first class; and WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren (Ordinance No. 7- 1963); and WHEREAS, notice of a Public Hearing was duly published and a Public hearing was conducted U as required by law (A.C.A. 14 -56 -422) on September 4, 2007; and WITEREAS, as a result of this hearing, the Planning Commission has recommended that certain property within the city limits of the City of Van Buren be rezoned, conditioned upon, the removal of the sign located thereon, from its previous classification to the following: Property Description Property Zoned New Zoning Lot 5 of the Grandview addition C -2 R -1 Section 24, Township 9, Range 32 more commonly known as 410 North 7 Street Van Buren, Arkansas WHEREAS, The proposed rezoning herein was recommended by a majority vote of the entire Planning Commission, in accordance with A.C.A. 14 -56 -422; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TFIE CITY OF VAN BUREN, ARKANSAS: e SECTION 1: The above described property is hereby rezoned, and the Van Buren Zoning Map is hereby amended to reflect this rezoning; and 0 SECTION 2: The adopted rezoning shall be filed in the office of the City Clerk, in accordance with A.C.A. 14 -56- 422(5); IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass, approve, and adopt, by a vote of tb for and 0 against, the foregoing Ordinance at its meeting held on the 24th day of September, 2007. The property consists of a 1712 square foot, three bedroom, two bath frame home with deck and outside storage shed. We purchased this home approximately three years ago, and at that time, it was zoned residential and had always been so. Shortly after purchasing the home, I requested and was granted a commercial rezoning. We operated a business in the home from March 2004 until March 2006, when 0 we moved to a larger location. Since that time, we have been trying to sell the property. In the eighteen months that this property has been for sale, we've had no one interested in using the home commercially, but many people have been interested in purchasing it for a residence. We currently have a contract of sale on the property (see attached) that is contingent on the property being rezoned residential. There are three other businesses on the street, all of which were residences at one time. Other than these three businesses, all of the property surrounding ours is residential.
